AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for operations of rescue and 3 emergency squad vehicles AND FOR COMMERCIAL DRIVER'S LICENSE. <-- 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1504(d)(3) SECTIONS 1504(D)(3) AND <-- 7 1606(B) of Title 75 of the Pennsylvania Consolidated Statutes is <-- 8 ARE amended to read: <-- 9 § 1504. Classes of licenses. 10 * * * 11 (d) Number and description of classes.--Licenses issued by 12 the department shall be classified in the following manner: 13 * * * 14 (3) Class C.--A Class C license shall be issued to those
1 persons 18 years of age or older, except as provided in 2 section 1503 (relating to persons ineligible for licensing), 3 who have demonstrated their qualifications to operate any 4 single vehicle with a gross vehicle weight rating of not more 5 than 26,000 pounds or any such vehicle towing a vehicle if 6 the gross combination vehicle weight rating is not more than 7 26,000 pounds. 8 (i) Where required under this title, appropriate 9 endorsements must be obtained. 10 (ii) Any firefighter who is the holder of a Class C 11 license and who has a certificate of authorization from 12 his fire chief shall be authorized to operate any fire or 13 emergency vehicle registered to the fire department OR <-- 14 MUNICIPALITY, regardless of the other requirements of 15 this section as to the class of license required. No fire 16 chief, fire department, including any volunteer fire 17 company, or municipality shall be liable for any civil 18 damages as a result of the issuance of a certificate 19 authorized under this paragraph unless such act 20 constituted a crime, actual fraud, actual malice or 21 willful misconduct. 22 (iii) Any member of a rescue or emergency squad who 23 is the holder of a Class C license and who has a 24 certificate of authorization from the head of the rescue 25 or emergency squad shall be authorized to operate any 26 rescue or emergency vehicle equipped with audible and 27 visual signals registered to the rescue or emergency 28 squad OR MUNICIPALITY, regardless of the other <-- 29 requirements of this section as to the class of license 30 required. 1 rescue or emergency squad or municipality shall be liable 2 for any civil damages as a result of the issuance of a 3 certificate of authorization under this paragraph unless 4 such issuance constituted a crime, actual fraud, actual 5 malice or willful misconduct. 6 [(iii)] (iv) The holder of a Class C license shall 7 also be authorized to drive a motorized pedalcycle or a 8 three-wheeled motorcycle equipped with an enclosed cab, 9 but not a motorcycle unless the license is endorsed, as 10 provided in this title. 11 * * * 12 § 1606. REQUIREMENT FOR COMMERCIAL DRIVER'S LICENSE. <-- 13 * * * 14 (B) EXEMPTIONS.--THE FOLLOWING PERSONS ARE NOT REQUIRED TO 15 OBTAIN A COMMERCIAL DRIVER'S LICENSE IN ORDER TO DRIVE THE 16 COMMERCIAL MOTOR VEHICLE SPECIFIED: 17 (1) A PERSON WITH A COMMERCIAL DRIVER LEARNER'S PERMIT 18 WHO IS ACCOMPANIED BY THE HOLDER OF A COMMERCIAL DRIVER'S 19 LICENSE VALID FOR THE VEHICLE BEING DRIVEN. 20 (2) A PERSON IN THE SERVICE OF THE ARMED FORCES OF THE 21 UNITED STATES, INCLUDING MEMBERS OF THE RESERVES AND NATIONAL 22 GUARD ON ACTIVE DUTY; PERSONNEL ON FULL-TIME NATIONAL GUARD 23 DUTY; AND PERSONNEL ON INACTIVE NATIONAL GUARD DUTY TRAINING 24 OR PART-TIME NATIONAL GUARD TRAINING AND NATIONAL GUARD 25 MILITARY TECHNICIANS WHO ARE REQUIRED TO WEAR MILITARY 26 UNIFORMS AND ARE SUBJECT TO THE UNIFORM CODE OF MILITARY 27 JUSTICE WHEN OPERATING EQUIPMENT OWNED OR OPERATED BY THE 28 DEPARTMENT OF DEFENSE. 29 (3) A PERSON WHO IS A VOLUNTEER OR PAID FIREFIGHTER WITH 30 A CLASS C LICENSE AND WHO HAS A CERTIFICATE OF AUTHORIZATION 19910H1484B3192 - 3 -
1 FROM HIS FIRE CHIEF WHILE OPERATING A FIRE OR EMERGENCY 2 VEHICLE REGISTERED TO THE FIRE DEPARTMENT OR MUNICIPALITY. 3 (4) ANY MEMBER OF A RESCUE OR EMERGENCY SQUAD WHO IS THE 4 HOLDER OF A CLASS C LICENSE AND WHO HAS A CERTIFICATE OF 5 AUTHORIZATION FROM THE HEAD OF THE RESCUE OR EMERGENCY SQUAD 6 WHILE OPERATING ANY RESCUE OR EMERGENCY VEHICLE EQUIPPED WITH 7 AUDIBLE AND VISUAL SIGNALS REGISTERED TO THE RESCUE OR 8 EMERGENCY SQUAD OR MUNICIPALITY. 9 [(4)] (5) A DRIVER WITH A CLASS C LICENSE OPERATING A 10 FARM VEHICLE WHICH IS CONTROLLED AND OPERATED BY A FARMER AND 11 USED EXCLUSIVELY TO TRANSPORT AGRICULTURAL PRODUCTS, FARM 12 MACHINERY OR FARM SUPPLIES TO OR FROM A FARM OWNED OR 13 OPERATED BY THE OWNER OF THE FARM VEHICLE. THE FARM VEHICLE 14 MAY NOT BE USED IN THE OPERATIONS OF A COMMON OR CONTRACT 15 CARRIER AND MAY BE USED ONLY WITHIN A RADIUS OF 150 MILES OF 16 THE FARM. 17 * * * 18 Section 2.
