AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, defining "direct contact with
3 children."
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 6303 of Title 23 of the Pennsylvania
7 Consolidated Statutes is amended by adding a definition to read:
8 § 6303. Definitions.
9 The following words and phrases when used in this chapter
10 shall have the meanings given to them in this section unless the
11 context clearly indicates otherwise:

13 "Direct contact with children." The care, supervision,
14 guidance or control of a child by a person, either paid or
15 unpaid, who provides child-care services.

17 Section 2. Section 6344(a) of Title 23, added December 19,
1 1990 (P.L. , No.206), is amended to read:
2 § 6344. Information relating to prospective child-care
3 personnel.
4 (a) Applicability.--This section applies to all prospective
5 employees of child-care services, prospective foster parents,
6 prospective adoptive parents, prospective self-employed family
7 day-care providers and other persons seeking to provide child-
8 care services under contract with a child-care facility or
9 program. This section does not apply to administrative or other
10 support personnel unless their duties will involve direct
11 contact with children. This section does apply to individuals
12 who have direct contact with children.
