                                     AN ACT

     1  Requiring warnings for sale of pressure-treated lumber;
     2     providing penalties; and conferring powers and duties on the
     3     Department of Environmental Resources.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Pressure-
     8  Treated Lumber Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Environmental Resources of
    14  the Commonwealth.
    15     "Pressure-treated lumber."  Any lumber treated with chemicals
    16  in order to prevent rot, infestation or general deterioration.
    17  Section 3.  Warning.


     1     (a)  Requirement.--A person may not sell pressure-treated
     2  lumber without an accompanying warning against burning the
     3  lumber.
     4     (b)  Penalty.--A person who violates subsection (a) commits a
     5  summary offense and shall, upon conviction, be sentenced to pay
     6  a fine of $50.
     7  Section 4.  Department.
     8     The department has the following powers and duties:
     9         (1)  To promulgate regulations as to the type, size and
    10     location of the warning required by section 3(a).
    11         (2)  To investigate violations of this act.
    12         (3)  To cooperate with the Office of Attorney General and
    13     with county district attorneys in prosecuting violations of
    14     this act.
    15  Section 5.  Effective date.
    16     This act shall take effect as follows:
    17         (1)  Section 4(1) and this section shall take effect in
    18     60 days.
    19         (2)  The remainder of this act shall take effect upon the
    20     effective date of the regulations promulgated under section
    21     4(1).
