                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, further providing for oral examination
     3     of parties applying for a marriage license.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1306 of Title 23 of the Pennsylvania
     7  Consolidated Statutes, added December 19, 1990 (P.L.    ,
     8  No.206), is amended to read:
     9  § 1306.  Oral examination.
    10     (a)  Appearance.--Each of the applicants for a marriage
    11  license shall appear in person and shall be examined under oath
    12  or affirmation as to:
    13         (1)  The legality of the contemplated marriage.
    14         (2)  Any prior marriage or marriages and its or their
    15     dissolution.
    16         (3)  The restrictions set forth in section 1304 (relating
    17     to restrictions on issuance of license).


     1         (4)  All the information required to be furnished on the
     2     application for license as prepared and approved by the
     3     department.
     4     (b)  Exception.--If an applicant is unable to appear in
     5  person, the clerk of the orphans' court shall provide that the
     6  person make an application by sworn affidavit. Affidavit forms
     7  shall be made available by the clerk of the orphans' court.
     8     Section 2.  This act shall take effect in 60 days.
