AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2 act to consolidate, editorially revise, and codify the public
3 welfare laws of the Commonwealth," providing for payments for
4 the Low-Income Home Energy Assistance Program.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 403(b) of the act of June 13, 1967
8 (P.L.31, No.21), known as the Public Welfare Code, amended April
9 8, 1982 (P.L.231, No.75), is amended to read:
10 Section 403. Uniformity in Administration of Assistance;
11 Regulations as to Assistance.--* * *
12 (b) The department shall establish rules, regulations and
13 standards, consistent with the law, as to eligibility for
14 assistance and as to its nature and extent.
15 (1) Whenever possible and consistent with State law, the
16 department shall establish rules, regulations and standards for
17 general assistance consistent with those established for aid to
1 families with dependent children. In no instance shall the 2 rules, regulations and standards established for general 3 assistance provide for benefits greater than those benefits 4 provided for aid to families with dependent children. 5 (2) The secretary or his designee in writing is the only 6 person authorized to adopt regulations, orders, or standards of 7 general application to implement, interpret, or make specific 8 the law administered by the department. 9 (3) The secretary shall issue interim regulations whenever 10 changes in Federal laws and regulations supersede existing 11 statutes. 12 (4) In adopting regulations, orders, or standards of general 13 application, the secretary shall strive for clarity of language 14 which may be readily understood by those administering aid and 15 by those who apply for or receive aid. 16 (5) Regulations for the Low-Income Home Energy Assistance 17 Program for fiscal year 1988-1989 shall provide for payments 18 according to the following table: 19 Household Size Maximum Income 20 1 $10,436 21 2 13,082 22 3 15,728 23 4 18,374 24 5 21,020 25 6 23,666 26 7 26,312 27 8 28,958 28 For each person over an eight-member 29 household, add $2,646. 30 * * * 19910H0272B0283 - 2 -
