SENATE BILL

        INTRODUCED BY MUSTO, WILT, LINCOLN, FISHER, BELAN, BODACK,
           STAPLETON, SHAFFER, STOUT, DAWIDA, RHOADES, HELFRICK,
           LEMMOND, PORTERFIELD, MADIGAN, BRIGHTBILL, STEWART, REGOLI,
           PETERSON AND PUNT, APRIL 27, 1990

        REFERRED TO ENVIRONMENTAL RESOURCES AND ENERGY, APRIL 27, 1990

                                     AN ACT

     1  Authorizing the incurring of indebtedness, with the approval of
     2     the electorate, of $150,000,000 for the creation of a State
     3     Public Land Trust to be used to acquire public lands,
     4     easements and rights-of-way by the Commonwealth, local
     5     governments and nonprofit conservancy organizations, and to
     6     maintain existing State parks; and imposing duties on the
     7     Department of Environmental Resources.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10  Section 1.  Question.
    11     The question of incurring indebtedness of $150,000,000 for
    12  the purpose of creating a State Public Land Trust to be used to
    13  acquire public lands, easements and rights-of-way for purposes
    14  of enhancing the recreational, scenic and historic value of land
    15  within this Commonwealth, and to maintain existing State parks,
    16  shall be submitted to the electors at the next primary,
    17  municipal or general election following the effective date of
    18  this act.
    19  Section 2.  Certification.


     1     The Secretary of the Commonwealth shall certify the form of
     2  the question under section 3 to the county boards of elections.
     3  Section 3.  Form of question.
     4     The question under section 1 shall be in substantially the
     5  following form:
     6         Do you favor the incurring of indebtedness by the
     7         Commonwealth of $150,000,000 for the creation of a State
     8         Public Land Trust to be used for the acquisition of
     9         public lands, easements and rights-of-way to enhance the
    10         recreational, scenic and historic value of lands within
    11         this Commonwealth and for the maintenance of existing
    12         State parks?
    13  Section 4.  Election.
    14     The election shall be conducted in accordance with the act of
    15  June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
    16  Election Code, except that the time limits for advertisement of
    17  notice of the elections may be waived as to the question.
    18  Section 5.  Proceeds.
    19     (a)  Purpose.--Proceeds of borrowing shall be used by the
    20  Commonwealth, local governments and nonprofit conservancy
    21  organizations to acquire lands, easements and rights-of-way to
    22  enhance recreational, scenic and historic values of land within
    23  this Commonwealth and to maintain existing State parks.
    24     (b)  Allocations.--Proceeds shall be allocated as follows:
    25         (1)  $100,000,000 for use by the Commonwealth, local
    26     governments and nonprofit conservancy organizations to
    27     acquire lands, easements and rights-of-way to enhance
    28     recreational, scenic and historical values of land within
    29     this Commonwealth.
    30         (2)  $50,000,000 to maintain existing State parks.

     1     (c)  Department of Environmental Resources plan to maintain
     2  parks.--Upon approval by the electorate of the referendum
     3  question authorized by this act, the Department of Environmental
     4  Resources shall submit to the General Assembly within 90 days a
     5  comprehensive plan for the use of the $50,000,000 allocated
     6  under subsection (b)(2). The plan shall include an itemized
     7  description of State parks maintenance needs and a proposed
     8  schedule for maintenance projects. The department shall update
     9  the plan annually.
    10  Section 6.  Effective date.
    11     This act shall take effect immediately.
