SENATE BILL

                                     AN ACT

     1  Amending the act of December 12, 1973 (P.L.397, No.141),
     2     entitled "An act relating to certification of teachers in the
     3     public schools of the Commonwealth and creating a
     4     Professional Standards and Practices Commission," further
     5     providing for the Professional Standards and Practices
     6     Commission and for certain disciplinary proceedings; and
     7     making a repeal.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 3 of the act of December 12, 1973
    11  (P.L.397, No.141), referred to as the Teacher Certification Law,
    12  amended December 14, 1989 (P.L.612, No.71), is amended to read:
    13     Section 3.  Professional Standards and Practices
    14  Commission.--There is hereby created a Professional Standards
    15  and Practices Commission consisting of thirteen members
    16  appointed by the Governor with the advice and consent of a
    17  majority of the members elected to the Senate. The term of
    18  office of members of the commission shall be three years
    19  [commencing on January 1 of the year following their
    20  appointment] except that the terms of office of members

     1  appointed in the calendar year 1990 shall expire on the third
     2  Tuesday of January 1993. Vacancies shall be filled for an
     3  unexpired term in the same manner as original appointments. No
     4  person shall serve for more than two consecutive terms as a
     5  member of the commission. The Governor may remove any member
     6  from the commission for misconduct or malfeasance in office,
     7  incapacity, or neglect of duty. All members of the commission
     8  shall be residents of the Commonwealth of Pennsylvania.
     9     Section 2.  Notwithstanding the repeal of other laws by the
    10  act of December 14, 1989 (P.L.612, No.71), entitled "An act
    11  amending the act of December 12, 1973 (P.L.397, No.141),
    12  entitled 'An act relating to certification of teachers in the
    13  public schools of the Commonwealth and creating a Professional
    14  Standards and Practices Commission,' further providing for the
    15  Professional Standards and Practices Commission and for certain
    16  disciplinary proceedings; and making a repeal," the Secretary of
    17  Education shall retain authority to conduct investigations and
    18  to discipline professional educators, as if those laws had not
    19  been repealed, with regard to any complaint received by the
    20  Department of Education prior to May 31, 1990. The act of
    21  December 14, 1989 (P.L.612, No.71) shall apply to disciplinary
    22  proceedings based upon complaints filed after May 31, 1990.
    23     Section 3.  Section 9 of the act of December 14, 1989
    24  (P.L.612, No.71), entitled "An act amending the act of December
    25  12, 1973 (P.L.397, No.141), entitled 'An act relating to
    26  certification of teachers in the public schools of the
    27  Commonwealth and creating a Professional Standards and Practices
    28  Commission,' further providing for the Professional Standards
    29  and Practices Commission and for certain disciplinary
    30  proceedings; and making a repeal," is repealed.

     1     Section 4.  Sections 2 and 3 of this act shall be retroactive
     2  to December 14, 1989.
     3     Section 5.  This act shall take effect immediately.
