SENATE BILL

No. 1334 Session of 1989

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," providing for the
    21     Unemployment Compensation Board of Review.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
    25  as The Administrative Code of 1929, is amended by adding a
    26  section to read:
    27     Section 442.2.  Unemployment Compensation Board of Review.--

     1  There is hereby created in the Department of Labor and Industry
     2  the Unemployment Compensation Board of Review. The board shall
     3  consist of at least three members, nominated and appointed by
     4  the Governor upon the consent of a majority of the members of
     5  the Senate. The term of a board member shall be for six years
     6  and until their successor is appointed and qualified. If the
     7  workload of the board justifies an increase in membership, the
     8  Governor may increase the number of members to no more than five
     9  and the additional members shall be selected as provided herein
    10  for other members. The Governor shall designate one member as
    11  chairman. Vacancies shall be filled for the remainder of the
    12  unexpired term.
    13     The Executive Board shall determine the salaries of the
    14  chairman and members of the Unemployment Compensation Board of
    15  Review. These salaries shall be paid from the Administration
    16  Fund.
    17     A majority of the members of the Unemployment Compensation
    18  Board shall constitute a quorum. An action of the board is valid
    19  only if it has the concurrence of the majority of votes cast at
    20  a meeting at which a quorum is present. A vacancy on the board
    21  shall not impair the right of a quorum of the full board to
    22  conduct business on behalf of the full board.
    23     Section 2.  Members of the Unemployment Compensation Board of
    24  Review appointed under authority heretofore contained in section
    25  203 of the act of December 5, 1936 (2nd Sp.Sess., 1937 P.L.2897,
    26  No.1), known as the Unemployment Compensation Law, shall
    27  continue to serve for the terms for which they were appointed
    28  and until successors shall be appointed and qualified.
    29     Section 3.  The following acts and parts of acts are
    30  repealed:

     1     Section 203(a) of the act of December 5, 1936 (2nd Sp.Sess.,
     2  1937 P.L.2897, No.1), known as the Unemployment Compensation
     3  Law.
     4     Act of June 28, 1989 (P.L.60, No.11), entitled "An act
     5  amending the act of September 2, 1961 (P.L.1177, No.525),
     6  entitled 'An act fixing the salaries and compensation of members
     7  of certain boards and commissions, and repealing inconsistent
     8  acts,' removing from the act the salaries of the Chairman and
     9  members of the Unemployment Compensation Board of Review; and
    10  making a repeal."
    11     Section 4.  This act shall take effect immediately.
