AN ACT
1 Authorizing the Board of the Troy Borough Municipal Authority to
2 transfer certain Project 70 lands in Troy Township, Bradford
3 County, to the Department of Transportation for a highway
4 project under certain conditions.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Authorization of transfer; conditions.
8 (a) Pursuant to the requirements of section 20(b) of the act
9 of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project
10 70 Land Acquisition and Borrowing Act, the General Assembly
11 authorizes the Board of the Troy Borough Municipal Authority to
12 transfer the hereinafter described land in Troy Township,
13 Bradford County, to the Department of Transportation for Highway
14 Project SR 0014, Section 043.
15 (b) The land shall be free of the restrictions on use and
16 alienation prescribed by section 20 of the Project 70 Land
17 Acquisition and Borrowing Act upon:
1 (1) the Department of Transportation making or agreeing
2 to make certain improvements beneficial to Alparon Park, as
3 agreed upon by the parties; and
4 (2) the execution and filing of a document of release
5 citing such agreed upon improvements and release of the land
6 from the restrictions on use and alienation prescribed by
7 section 20(b) of the act.
8 (c) The document of release shall be prepared in the manner
9 provided by law and filed in the office of the recorder of deeds
10 of the county in which the land is located. Compliance with this
11 subsection constitutes the express approval of the General
12 Assembly of the release of the restrictions on the use or
13 alienation of lands acquired by the Department of Transportation
14 required by section 20(b) of the act.
15 Section 2. Description of Project 70 land to be transferred.
16 The land to be transferred by the Board of the Troy Borough
17 Municipal Authority to the Department of Transportation for
18 Highway Project SR 0014, Section 043, is more particularly
19 described as follows:
20 PARCEL 1
21 All that certain parcel of land situated in the Township of
22 Troy, Bradford County, Pennsylvania, as shown on a plan titled
23 "Parcel 1 Required Project 70 Lands for Highway Project SR 0014,
24 Section 043", and plan titled, "Drawings Showing Required Right-
25 of-way for improvement to SR 0014, Section 043", prepared by the
26 Pennsylvania Department of Transportation and dated February 21,
27 1989, said parcel being more particularly bounded and described
28 as follows:
29 Beginning at a point on the eastern existing legal right-of-
30 way line, twenty-five (25) feet from a point on the center of

1 existing SR 0014, said center line point being one hundred
2 forty-one (141) feet more or less from the existing SR 0014
3 Bridge over the North Branch of Sugar Creek, said beginning
4 point also being 58.5 feet left of Station 846+05 on SR 0014
5 relocated, as shown on plan of SR 0014, Section 043, Bradford
6 County; thence from the aforementioned beginning point the
7 following courses and distances: (1) along the eastern legal
8 right-of-way line north 52 degrees 10 minutes 12 seconds east
9 97.74 feet to a point on the aforementioned right-of-way line
10 said point being the northeast corner of this parcel; (2) thence
11 on a curve to the right with a radius of 1942.79 feet for an arc
12 length of 34.12 feet, chord for same being south 9 degrees 9
13 minutes 55 seconds west 34.12 feet; (3) thence on a curve to the
14 right with a radius of 3852.80 feet for an arc length of 165.00
15 feet, chord for same being south 10 degrees 52 minutes 56
16 seconds west 164.99 feet to a point being the southeast corner;
17 (4) thence south 49 degrees 27 minutes 30 seconds west 110.47
18 feet to a point being the southwest corner; (5) thence on a
19 curve to the left with a radius of 3786.8 feet for an arc length
20 of 212.06 feet, chord for same being north 11 degrees 47 minutes
21 31 seconds east 212.03 feet to a point and place of beginning on
22 the existing legal right-of-way of SR 0014. Containing 0.31
23 acres.
24 Being part of the same premises conveyed to the Troy Borough
25 Municipal Authority by the Penn Central Corporation by deed
26 dated November 17, 1980 and recorded December 12, 1980 in
27 Bradford County, Pennsylvania, Deed Book 673, page 278.
28 PARCEL 2
29 All that certain parcel of land situated in the Township of
30 Troy, Bradford County, Pennsylvania, as shown on a plan titled

1 "Parcel 2 Required Project 70 Lands for Highway Project SR 0014, <--
2 Section 043", and plan titled, "Drawings Showing Required Right-
3 of-way for improvement to SR 0014, Section 043" prepared by the
4 Pennsylvania Department of Transportation and dated February 21,
5 1989, said parcel being more particularly bounded and described
6 as follows:
7 Beginning at a point on the western existing legal right-of-
8 way line, twenty-five (25) feet from a point in the center of
9 existing SR 0014, said centerline point being two hundred ten
10 (210) feet more or less from the existing SR 0014 Bridge over
11 the North Branch of Sugar Creek, said beginning point also being
12 75 feet left of Station 846+90 on SR 0014 relocated, as shown on
13 plan of SR 0014, Section 043, Bradford County; thence from the
14 aforementioned beginning point the following courses and
15 distances along the required right-of-way line for relocated SR
16 0014: (1) thence north 31 degrees 21 minutes 40 seconds east
17 230.67 feet to a point; (2) thence along the same on a curve to
18 the left with a radius of 909.93 feet for an arc length of
19 356.22 feet, chord for same being north 6 degrees 49 minutes 37
20 seconds east 353.95 feet to a point; (3) thence along the same
21 north 1 degree 34 minutes 53 seconds west 96.38 feet to a point;
22 (4) thence along the same on a curve to the left with a radius
23 of 919.93 feet for an arc length of 184.00 feet, chord for same
24 being north 16 degrees 4 minutes 13 seconds west 183.69 feet to
25 a point; (5) thence along the same north 23 degrees 39 minutes 6
26 seconds west 171.95 feet to a point; (6) thence along the same
27 north 27 degrees 3 minutes 1 second west 108.85 feet to a point;
28 (7) thence along the same north 62 degrees 56 minutes 53 seconds
29 east 5.00 feet to a point on the western existing legal right-
30 of-way line for SR 0014, said point being 25 feet from

1 centerline of said highway; thence along the western existing
2 legal right-of-way line the following courses and distances; (8)
3 South 26 degrees 58 minutes 49 seconds east 184.24 to a point;
4 (9) thence along the same on a curve to the right on a radius of
5 793.51 feet for an arc length of 226.65 feet, chord for the same
6 being south 17 degrees 21 minutes 13 seconds east 265.40 feet to
7 a point; (10) thence along the same south 7 degrees 43 minutes
8 36 seconds east 278.48 feet to a point; (11) thence along same
9 on a curve to the right on a radius of 333.10 feet for an arc
10 length of 381.95 feet, chord for same being south 21 degrees 31
11 minutes and no seconds west 361.37 feet to a point; (12) thence
12 along the same south 52 degrees 9 minutes 28 seconds west 78.80
13 feet to a point and place of beginning on the existing legal
14 right-of-way of SR 0014. Containing 0.59 acres.
15 The southern portion (0.05 acres) of Parcel 2 being part of
16 the same premises conveyed to the Troy Borough Municipal
17 Authority by the Penn Central Corporation by deed dated November
18 17, 1980 and recorded December 12, 1980 in Bradford County,
19 Pennsylvania, Deed Book 673 page 278. The remaining portion
20 (0.54 acres) of Parcel 2 being part of the same premises
21 conveyed to the Troy Borough Municipal Authority by the Bradford
22 County Commissioners by Deed dated 1987 and recorded July 27,
23 1987 in Bradford County, Pennsylvania, Deed Book 60 page 816.
24 Section 3. Effective date.
25 This act shall take effect immediately.
