AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, authorizing dealers of motor carrier vehicles and
3 designated agents of the Department of Transportation to be
4 agents for the Department of Revenue for certain purposes
5 relating to the motor carrier road tax identification marker; <--
6 AND FURTHER PROVIDING FOR PENALTIES FOR OPERATION OF CERTAIN
7 VEHICLES WITHOUT REQUIRED IDENTIFICATION MARKERS.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 2102(c) of Title 75 of the Pennsylvania
11 Consolidated Statutes is amended to read:
12 § 2102. Identification markers required.

14 (c) Issuance of markers.--
15 (1) Identification markers shall be issued on a 12-month
16 basis, effective April 1 of each year, and shall be valid
17 through the next succeeding March 31; however, enforcement of
18 this section shall not become effective until April 15 of
19 each year as to motor carrier vehicles displaying the
20 previous year's identification marker.
1 (2) The Department of Revenue shall have the power and 2 may designate dealers of motor carrier vehicles, the 3 department and designated agents of the department located 4 within this Commonwealth to act as agents for the Department 5 of Revenue for the purpose of collecting the fee under 6 subsection (b), processing the necessary papers and issuing a 7 temporary permit to authorize the operation of a motor 8 carrier vehicle pending issuance of a permanent 9 identification marker by the department. 10 * * * 11 Section 2. This act shall take effect in 180 days. <-- 12 SECTION 2. SECTION 2103 OF TITLE 75 IS AMENDED BY ADDING A <-- 13 SUBSECTION TO READ: 14 § 2103. FALSE STATEMENTS AND PENALTIES. 15 * * * 16 (A.1) OPERATION WITHOUT IDENTIFICATION MARKER.-- 17 NOTWITHSTANDING THE PROVISIONS OF SUBSECTION (B), ANY PERSON WHO 18 VIOLATES SECTION 2102(D) (RELATING TO IDENTIFICATION MARKERS 19 REQUIRED) AND WHO CAN ADEQUATELY ESTABLISH AN ABSENCE OF KNOWING 20 AND WILLFUL INTENT SHALL BE GUILTY OF A SUMMARY OFFENSE AND 21 SHALL BE SENTENCED TO PAY A FINE OF $25. 22 * * * 23 SECTION 3. THIS ACT SHALL TAKE EFFECT AS FOLLOWS: 24 (1) SECTION 1 (SECTION 2102) OF THIS ACT SHALL TAKE 25 EFFECT IN 180 DAYS. 26 (2) THE REMAINDER OF THIS ACT SHALL TAKE EFFECT IN 60 27 DAYS.
