                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for the Office
     3     of State Public Defender.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 9552.  State Public Defender.
     9     (a)  Establishment.--There is hereby created the Office of
    10  State Public Defender.
    11     (b)  Appointment and term of office.--The State Public
    12  Defender shall be appointed by the Governor and shall serve for
    13  a term of eight years. The State Public Defender may be
    14  appointed to one additional term.
    15     (c)  Powers and duties.--The State Public Defender shall act
    16  as legal counsel to every criminal defendant involved in an
    17  appeal to the Supreme or Superior Court who, for lack of
    18  sufficient funds, is unable to hire legal counsel.

     1     (d)  Personnel and compensation.--The State Public Defender,
     2  with the approval of the Governor, may appoint as many full-time
     3  or part-time assistant public defenders, clerks, investigators,
     4  stenographers and other employees as he may deem necessary to
     5  enable him to carry out the duties of his office. The Executive
     6  Board shall fix the salary of the State Public Defender and the
     7  personnel authorized by this section.
     8     Section 2.  This act shall take effect in 60 days.
