AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," requiring agencies to 21 advertise in daily newspapers within municipalities when a 22 lease of a building or use of a building located in the 23 municipality is to be terminated or not renewed; AND <-- 24 PROVIDING FOR THE USE OF PROCEEDS FROM THE SALE OR LEASE OF 25 CERTAIN REAL ESTATE. 26 The General Assembly of the Commonwealth of Pennsylvania 27 hereby enacts as follows: 28 Section 1. The act of April 9, 1929 (P.L.177, No.175), known
1 as The Administrative Code of 1929, is amended by adding a 2 section to read: 3 Section 2402.1. Advertisement of Termination or Nonrenewal 4 of Lease or Use of Buildings.--With the exception of buildings 5 connected with the State Capitol Complex in Harrisburg, prior to 6 a decision to terminate or not to renew a lease of a building or 7 portion of a building which the Commonwealth is leasing from 8 another party, or a decision to terminate or not to renew the 9 use or a material change in the use of a building owned by the 10 Commonwealth, the chief administrative officer of the State 11 agency involved shall advertise the possibility of termination 12 or nonrenewal in a daily newspaper of general circulation which 13 serves the municipality in which the building is located. If 14 there is more than one daily newspaper serving the municipality, 15 the State agency shall advertise in the paper that has the 16 largest circulation. 17 SECTION 2. SECTION 2406-A OF THE ACT, ADDED JULY 1, 1981 <-- 18 (P.L.143, NO.48), IS AMENDED TO READ: 19 SECTION 2406-A. ALLOCATION OF SALE PROCEEDS.--THE PROCEEDS 20 OF THE SALE OF REAL ESTATE UNDER THE PROVISIONS OF SECTION 2405- 21 A SHALL BE PAID INTO THE STATE TREASURY, THROUGH THE DEPARTMENT 22 OF REVENUE AND DEPOSITED IN THE CAPITAL FACILITIES REDEMPTION 23 FUND, OR IF THE LAND WAS ACQUIRED BY MONEYS WHOLLY OR MAINLY OUT 24 OF A SPECIAL FUND, SUCH PROCEEDS SHALL BE CREDITED TO THE PROPER 25 SPECIAL FUND, AND ALL PROCEEDS OF THE SALE OF AUTHORITY 26 PROPERTIES SHALL BE PAID TO THE RESPECTIVE FISCAL AGENT OF THE 27 AUTHORITY IN ACCORDANCE WITH THE BOND RESOLUTION. THE COSTS AND 28 FEES INCURRED BY THE DEPARTMENT OF GENERAL SERVICES, INCLUDING 29 BUT NOT LIMITED TO COSTS OF TITLE SEARCHES, NOTICE, SURVEYS AND 30 APPRAISALS, SHALL BE DEDUCTED FROM THE PURCHASE PRICE AND THAT 19890S0373B2318 - 2 -
1 AMOUNT SHALL BE AN EXECUTIVELY AUTHORIZED AUGMENTATION TO THE 2 APPROPRIATION FROM WHICH THE COSTS AND FEES WERE PAID BY THE 3 DEPARTMENT. NOTWITHSTANDING THE FOREGOING, THE PROCEEDS FROM THE 4 SALE OR LEASE OF REAL ESTATE USED FOR THE TREATMENT OF THE 5 MENTALLY ILL OR MENTALLY RETARDED SHALL BE USED SOLELY FOR THE 6 NEEDS OF THE MENTALLY ILL OR MENTALLY RETARDED. 7 Section 2 3.
