                                     AN ACT

     1  Amending the act of April 12, 1951 (P.L.90, No.21), entitled as
     2     reenacted "An act relating to alcoholic liquors, alcohol and
     3     malt and brewed beverages; amending, revising, consolidating
     4     and changing the laws relating thereto; regulating and
     5     restricting the manufacture, purchase, sale, possession,
     6     consumption, importation, transportation, furnishing, holding
     7     in bond, holding in storage, traffic in and use of alcoholic
     8     liquors, alcohol and malt and brewed beverages and the
     9     persons engaged or employed therein; defining the powers and
    10     duties of the Pennsylvania Liquor Control Board; providing
    11     for the establishment and operation of State liquor stores,
    12     for the payment of certain license fees to the respective
    13     municipalities and townships, for the abatement of certain
    14     nuisances and, in certain cases, for search and seizure
    15     without warrant; prescribing penalties and forfeitures;
    16     providing for local option, and repealing existing laws,"
    17     further providing for the sale of liquor to licensees; and
    18     providing for sale of liquor and wine to certain retail
    19     purchasers.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  Section 305(b) of the act of April 12, 1951
    23  (P.L.90, No.21), known as the Liquor Code, reenacted and amended
    24  June 29, 1987 (P.L.32, No.14), is amended and the section is
    25  amended by adding a subsection to read:
    26     Section 305.  Sales by Pennsylvania Liquor Stores.--* * *

     1     (b)  Every Pennsylvania Liquor Store shall sell liquors at
     2  wholesale to hotels, restaurants, clubs, and railroad, pullman
     3  and steamship companies licensed under this act; and, under the
     4  regulations of the board, to pharmacists duly licensed and
     5  registered under the laws of the Commonwealth, and to
     6  manufacturing pharmacists, and to reputable hospitals approved
     7  by the board, or chemists. Sales to licensees shall be made at a
     8  price that includes a discount of twelve and one-half per centum
     9  from the retail price. The board may sell to registered
    10  pharmacists only such liquors as conform to the Pharmacopoeia of
    11  the United States, the National Formulary, or the American
    12  Homeopathic Pharmacopoeia. The board may sell at special prices
    13  under the regulations of the board, to United States Armed
    14  Forces facilities which are located on United States Armed
    15  Forces installations and are conducted pursuant to the authority
    16  and regulations of the United States Armed Forces. All other
    17  sales by such stores shall be at retail. A person entitled to
    18  purchase liquor at wholesale prices may purchase the liquor at
    19  any Pennsylvania Liquor Store upon tendering cash, check or
    20  credit card for the full amount of the purchase. For this
    21  purpose, the board shall issue a discount card to each licensee
    22  identifying such licensee as a person authorized to purchase
    23  liquor at wholesale prices. Such discount card shall be retained
    24  by the licensee. The board may contract through the Commonwealth
    25  bidding process for delivery to wholesale licensees at the
    26  expense of the licensee receiving the delivery.

    28     (c.1)  The board shall allow volume discounts to retail
    29  purchasers as provided in this subsection. A discount of five
    30  per centum from the retail price shall be allowed to persons who

     1  purchase one to five cases of liquor or wine. A discount of ten
     2  per centum from the retail price shall be allowed to persons who
     3  purchase six or more cases of liquor or wine.
     4     Section 2.  This act shall take effect immediately.
