HOUSE BILL

No. 2449 Session of 1990

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor and the Secretary of Public
     3     Welfare, to convey to Nevillewood Associates, L.P., 75.346
     4     acres of land, more or less, situate in Collier Township,
     5     Allegheny County, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Governor and the Secretary of Public Welfare, is
    10  hereby authorized and directed on behalf of the Commonwealth of
    11  Pennsylvania to grant and convey to Nevillewood Associates,
    12  L.P., a Pennsylvania limited partnership, for a consideration of
    13  fair market value, as determined by an appraisal of the
    14  Department of General Services, the following described land
    15  situate in Collier Township, Allegheny County, Pennsylvania,
    16  bounded and described as follows:
    17     (1)  All that certain tract or parcel of land situate in the
    18  Township of Collier, County of Allegheny and Commonwealth of
    19  Pennsylvania, being more particularly bounded and described as

     1  follows, to wit:
     2     Beginning at a point in Hill Top Road 33 feet in width and at
     3  corner of property now or formerly the Commonwealth of
     4  Pennsylvania; thence along said Road north 65 degrees 57 minutes
     5  ten seconds east a distance of 332.00 feet to a point; thence
     6  through land now or formerly the Commonwealth of Pennsylvania
     7  the following three courses and distances: south 01 degrees 19
     8  minutes 00 seconds west a distance of 1104.90 feet to a point;
     9  thence north 88 degrees 41 minutes 00 seconds west a distance of
    10  1195.09 feet to a point; thence south 18 degrees 02 minutes 50
    11  seconds west a distance of 1068.73 feet to a point on the
    12  dividing line of property herein described and land now or
    13  formerly J. H. Ferri et al; thence along same the following two
    14  courses and distances: north 76 degrees 44 minutes 45 seconds
    15  west a distance of 547.86 feet to a point; thence north 17
    16  degrees 27 minutes 30 seconds west a distance of 678.75 feet to
    17  a point; thence through property now or formerly the
    18  Commonwealth of Pennsylvania north 36 degrees 00 minutes 00
    19  seconds west a distance of 1125.00 feet to a point; thence north
    20  19 degrees 47 minutes 00 seconds east a distance of 829.53 feet
    21  to a point in Hill Top Road; thence in said road south 70
    22  degrees 13 minutes 00 seconds east a distance of 1609.26 feet to
    23  a point; thence thru property now or formerly the Commonwealth
    24  of Pennsylvania south 01 degrees 19 minutes 00 seconds west a
    25  distance of 754.24 feet to a point; thence south 88 degrees 41
    26  minutes 00 seconds east a distance of 850.00 feet to a point;
    27  thence north 01 degrees 19 minutes 00 seconds east a distance of
    28  812.68 feet to a point in Hill Top Road the place of beginning.
    29     Containing 3,156,690.578 square feet or 72.468 acres.
    30     Having erected thereon a two-story brick office building and

     1  an incinerator building.
     2     Excepting and reserving unto the Commonwealth of
     3  Pennsylvania, however, the existing incinerator building located
     4  upon the premises together with rights in the underlying real
     5  estate sufficient to enable the said building to continue to
     6  exist and be maintained in its present location and also
     7  together with an easement or right-of-way for ingress, egress
     8  and regress between the said building and Hill Top Road, the
     9  location of said easement to be determined by mutual consent of
    10  the Commonwealth and Nevillewood Associates, L.P.; the aforesaid
    11  rights accepted and reserved hereby and the accompanying
    12  easement to exist until such time as the said incinerator
    13  building is razed, at which time the said rights and easement
    14  shall extinguish without further action of the parties.
    15     (2)  All that certain tract or parcel of land situate in the
    16  Township of Collier, County of Allegheny and Commonwealth of
    17  Pennsylvania, being more particularly bounded and described as
    18  follows, to wit:
    19     Beginning at a point on or near the centerline of Hill Top
    20  Road, L.R. 02022, a 33-foot right-of-way, where the same is
    21  intersected by Boyds Run Road, L.R. 02344, a 33-foot right-of-
    22  way, and Walkers Mill Road, L.R. 02041, a 33-foot right-of-way,
    23  said point being a common corner to lands now or formerly of
    24  Equitable Gas Company, the Township of Collier, and the parcel
    25  herein described, thence continuing with the centerline of Hill
    26  Top Road in an easterly direction for the following five courses
    27  and distances: north 81 degrees 34 minutes 00 seconds east for a
    28  distance of 241.66 feet to a point of curve; thence by the arc
    29  of a circle curving to the left, having a radius of 1330.00 feet
    30  for an arc distance of 298.67 feet to a point of tangency;

     1  thence north 68 degrees 42 minutes 00 seconds east for a
     2  distance of 189.65 feet to a point, said point being the true
     3  place of beginning; thence continuing with the centerline of
     4  Hill Top Road, north 68 degrees 42 minutes 00 seconds east for a
     5  distance of 50.29 feet to a point; thence by a line through
     6  lands of which this was formerly a part for the following 15
     7  courses and distances: south 15 degrees 09 minutes 20 seconds
     8  east for a distance of 135.73 feet to a point; thence south 06
     9  degrees 35 minutes 20 seconds west for a distance of 139.50 feet
    10  to a point; thence south 03 degrees 25 minutes 25 seconds west
    11  for a distance of 340.82 feet to a point of curve; thence by the
    12  arc of a circle curving to the left, having a radius of 25 feet
    13  for an arc distance of 58.90 feet to a point of tangency; thence
    14  north 48 degrees 25 minutes 50 seconds east for a distance of
    15  534.28 feet to a point; thence north 41 degrees 34 minutes 10
    16  seconds west for a distance of 60 feet to a point; thence north
    17  48 degrees 25 minutes 50 seconds east for a distance of 250 feet
    18  to a point; thence south 41 degrees 34 minutes 10 seconds east
    19  for a distance of 250 feet to a point; thence south 48 degrees
    20  25 minutes 50 seconds west for a distance of 250 feet to a
    21  point; thence north 41 degrees 34 minutes 10 seconds west for a
    22  distance of 140 feet to a point; thence south 48 degrees 25
    23  minutes 50 seconds west for a distance of 534.28 feet to a point
    24  of curve; thence by the arc of a circle curving to the right,
    25  having a radius of 75 feet for an arc distance of 176.71 feet to
    26  a point of tangency; thence north 03 degrees 25 minutes 25
    27  seconds east for a distance of 342.22 feet to a point; thence
    28  north 06 degrees 35 minutes 20 seconds east for a distance of
    29  131.26 feet to a point; thence north 15 degrees 09 minutes 20
    30  seconds west for a distance of 120.72 feet to a point, said

     1  point being the true place of beginning. Parcel as herein
     2  described containing an area of 2.878 acres.
     3     Section 2.  The conveyances shall be made under and subject
     4  to all easements, servitudes and rights of others, including,
     5  but not confined to, streets, roadways and rights of telephone,
     6  telegraph, water, electric, sewer, gas or pipeline companies, as
     7  well as under and subject to any interest, estates or tenancies
     8  vested in third persons, whether or not appearing of record, for
     9  any portion of the land or improvements erected thereon.
    10     Section 3.  The deeds of conveyance shall be approved as
    11  provided by law and shall be executed by the Secretary of
    12  General Services in the name of the Commonwealth of Pennsylvania
    13  and delivered to the grantee within 60 days after the effective
    14  date of this act.
    15     Section 4.  Costs and fees incidental to the conveyances
    16  shall be borne by the grantee.
    17     Section 5.  This act shall take effect immediately.
