AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2 act to consolidate, editorially revise, and codify the public
3 welfare laws of the Commonwealth," providing for drug testing
4 of employees of child day care facilities.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The act of June 13, 1967 (P.L.31, No.21), known
8 as the Public Welfare Code, is amended by adding a section to
9 read:
10 Section 1010. Employe health appraisal.--As part of the
11 regularly required health appraisal as provided for in the
12 regulations of the department, all employes of every facility
13 which provides child day care and which is licensed or
14 registered under this article or Article IX shall undergo annual
15 testing for the use of controlled substances, as described in
16 the act of April 14, 1972 (P.L.233, No.64), known as "The
17 Controlled Substance, Drug, Device and Cosmetic Act." The
1 department shall by regulation adopt procedures for this
2 testing.
3 Section 2. All acts and parts of acts are repealed insofar
4 as they are inconsistent with this act.
5 Section 3. This act shall take effect immediately.
