                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for expungement.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 9122(a) of Title 18 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 9122.  Expungement.
     8     (a)  Specific proceedings.--Criminal history record
     9  information shall be expunged in a specific criminal proceeding
    10  when any of the following occur:
    11         (1)  [no] No disposition has been received or, upon
    12     request for criminal history record information, no
    13     disposition has been recorded in the repository within 18
    14     months after the date of arrest and the court of proper
    15     jurisdiction certifies to the director of the repository that
    16     no disposition is available and no action is pending.
    17     Expungement shall not occur until the certification from the
    18     court is received and the director of the repository

     1     authorizes such expungement[; or].
     2         (2)  [a] A court order requires that such nonconviction
     3     data be expunged.
     4         (3)  A court order requires that the criminal record be
     5     expunged in a case where the Governor has pardoned the
     6     defendant for the crime on which the record is based.

     8     Section 2.  This act shall take effect in 60 days.
