                                     AN ACT

     1  Amending the act of June 2, 1915 (P.L.736, No.338), entitled "An
     2     act defining the liability of an employer to pay damages for
     3     injuries received by an employe in the course of employment;
     4     establishing an elective schedule of compensation; providing
     5     procedure for the determination of liability and compensation
     6     thereunder; and prescribing penalties," further providing for
     7     definition of "employer."

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 103 of the act of June 2, 1915 (P.L.736,
    11  No.338), known as The Pennsylvania Workmen's Compensation Act,
    12  reenacted and amended June 21, 1939 (P.L.520, No.281), is
    13  amended to read:
    14     Section 103.  (a)  The term "employer," as used in this act,
    15  is declared to be synonymous with master, and, except as
    16  provided in subsection (b), to include natural persons,
    17  partnerships, joint-stock companies, corporations for profit,
    18  corporations not for profit, municipal corporations, the


     1  Commonwealth, and all governmental agencies created by it.
     2     (b)  The term "employer" shall not include S corporations, as
     3  defined in 26 U.S.C. § 1361 (Public Law 97-354), or partnerships
     4  which have no employes except the shareholders of the S
     5  corporation or the partners of the partnership.
     6     Section 2.  This act shall take effect in 60 days.
