AN ACT 1 Prohibiting local government units and authorities from imposing 2 certain residency requirements for employees. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Definitions. 6 The following words and phrases when used in this act shall 7 have the meanings given to them in this section unless the 8 context clearly indicates otherwise: 9 "Authority." An authority or nonprofit corporation organized 10 under any law of this Commonwealth. The term includes a joint 11 authority incorporated by two or more municipalities. 12 "Local government unit." A county, county institution 13 district, city, borough, incorporated town, township, school 14 district or any similar, general or limited purpose unit of 15 local government or any unit created by joint action of two or 16 more local government units which is now or shall hereafter be 17 authorized to be created by the General Assembly. The term
1 includes a local government unit operating under a home rule 2 charter. 3 Section 2. Local government unit prohibited from imposing 4 certain residency requirements. 5 (a) General rule.--A local government unit shall not have 6 the power, with regard to a position of employment that is 7 funded either in whole or in part, directly or indirectly, by 8 money received from the Commonwealth or the Federal Government, 9 to require that an applicant for the position or that an 10 employee filling the position reside within the physical 11 boundaries of the local government unit as a condition of 12 application for employment or as a condition of employment. 13 (b) Exception.--Subsection (a) shall not prohibit a local 14 government unit from requiring residence within the local 15 government unit as a condition of application for employment and 16 as a condition of employment in the case of employees directly 17 involved in preserving public safety who must reside in close 18 proximity to their place of work in order to properly preserve 19 public safety. 20 Section 3. Authority prohibited from imposing certain residency 21 requirements. 22 (a) General rule.--An authority shall not have the power, 23 with regard to a position of employment that is funded, either 24 in whole or in part, directly or indirectly, by money received 25 from the Commonwealth or the Federal Government to require that 26 an applicant for the position or that an employee filling the 27 position reside within the physical boundaries of the 28 municipality or municipalities that established the authority or 29 within the service area of the authority as a condition of 30 application for employment or as a condition of employment. 19900H2276B3055 - 2 -
1 (b) Exception.--Subsection (a) shall not prohibit an 2 authority from requiring residence within the municipality or 3 municipalities that established the authority or within the 4 service area of the authority as a condition of application for 5 employment and as a condition of employment in the case of 6 employees directly involved in preserving public safety who must 7 reside in close proximity to their place of work in order to 8 properly preserve public safety. 9 Section 4.
