                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting a person who accepts
     3     credit cards from requiring the cardholder to provide
     4     personal identification information.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 7326.  Requiring personal identification information in
    10             connection with credit card transaction.
    11     (a)  Offense.--A person who accepts credit cards for the
    12  transaction of business commits a summary offense if he requires
    13  the credit cardholder to write on the credit card transaction
    14  form, or causes to be written on the credit card transaction
    15  form, any personal identification information not required by
    16  the credit card issuer to complete the transaction, including,
    17  but not limited to, the credit cardholder's address and
    18  telephone number.

     1     (b)  Exceptions.--Subsection (a) shall not apply where:
     2         (1)  personal identification information is required for
     3     shipping, delivery or installation of merchandise;
     4         (2)  the transaction involves special order merchandise;
     5         (3)  authorization from the credit card issuer concerning
     6     the availability of credit is not required by the issuer to
     7     complete the credit card transaction; or
     8         (4)  the person who accepts the credit card processes
     9     credit card transactions by mailing transaction forms to a
    10     designated bankcard center for settlement.
    11     (c)  Definition.--As used in this section, the term "credit
    12  card" means a writing, number or other evidence of an
    13  undertaking to pay for property or services delivered or
    14  rendered to or upon the order of a designated person or bearer.
    15     Section 2.  This act shall take effect in 60 days.
