        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 24, 1990

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," authorizing the Department
    21     of Corrections to grant a license to the United States Park
    22     Service to erect and maintain certain radio
    23     telecommunications equipment on the land of the State
    24     Correctional Institution at Cresson, Cambria County; AND       <--
    25     AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES, WITH THE
    26     APPROVAL OF THE GOVERNOR, TO ACQUIRE CERTAIN TRACTS OF LAND
    27     IN THE CITY OF PITTSBURGH, ALLEGHENY COUNTY, FOR THE USE OF
    28     THE DEPARTMENT OF CORRECTIONS.

    29     The General Assembly of the Commonwealth of Pennsylvania
    30  hereby enacts as follows:

     1     Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
     2  as The Administrative Code of 1929, is amended by adding a
     3  section to read:
     4     Section 902-B 903-B.  Grant of License to United States Park   <--
     5  Service.--The Department of Corrections may, with the approval
     6  of the Governor, grant a license to the United States Park
     7  Service to place upon, in, or over, any dry or submerged land or
     8  bridge or structure of or maintained by the Commonwealth within
     9  the reservation of the State Correctional Institution at Cresson
    10  in the County of Cambria, radio and telecommunications equipment
    11  if such equipment is necessary to perform the functions of the
    12  United States Park Service. This license shall be revocable for
    13  reasonable cause upon six months' written notice by the
    14  Commonwealth, and also after like notice for violation of such
    15  proper terms and conditions as the Department of Corrections,
    16  with the approval of the Governor, shall prescribe when the
    17  license issues. The license shall provide for the payment to the
    18  Commonwealth of compensation for the use of its property in such
    19  amount as the Department of Corrections shall, with the approval
    20  of the Governor, prescribe.
    21     SECTION 2.  (A)  THE DEPARTMENT OF GENERAL SERVICES, WITH THE  <--
    22  APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED TO PURCHASE IN
    23  THE NAME OF THE COMMONWEALTH OF PENNSYLVANIA, FOR THE USE OF THE
    24  DEPARTMENT OF CORRECTIONS, ANY OR ALL SUCH RIGHT, TITLE OR
    25  ESTATE AS MAY BE AVAILABLE IN AND TO THE FOLLOWING TRACT OF LAND
    26  IN THE 27TH WARD OF THE CITY OF PITTSBURGH, ALLEGHENY COUNTY,
    27  PENNSYLVANIA, CONTAINING APPROXIMATELY 24,148 SQUARE FEET,
    28  BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE
    29  SOUTHERLY LINE OF WESTHALL STREET, SAID POINT BEING NORTH 87
    30  DEGREES 49 MINUTES 01 SECONDS EAST A DISTANCE OF 88.853 FEET

     1  FROM THE INTERSECTION OF THE SOUTHERLY LINE OF WESTHALL STREET
     2  AND THE FORMER WESTERLY LINE OF REFUGE STREET (VACATED BY CITY
     3  OF PITTSBURGH ORDINANCE NO. 227 OF 1974); THENCE SOUTHWARDLY
     4  ALONG A LINE OF PROPERTY NOW OR FORMERLY OF THE COMMONWEALTH OF
     5  PENNSYLVANIA, SOUTH 15 DEGREES 13 MINUTES 53 SECONDS EAST A
     6  DISTANCE OF 157.713 FEET TO A POINT ON THE FORMER NORTHERLY LINE
     7  OF ECKERT STREET (VACATED BY CITY OF PITTSBURGH ORDINANCE NO.
     8  277 OF 1974); THENCE EASTWARDLY ALONG SAID LINE NORTH 87 DEGREES
     9  40 MINUTES 31 SECONDS EAST A DISTANCE OF 140.400 FEET TO A POINT
    10  ON THE WESTERLY LINE OF NEW BEAVER AVENUE; THENCE NORTHWARDLY
    11  ALONG SAID WESTERLY LINE OF NEW BEAVER AVENUE NORTH 2 DEGREES 10
    12  MINUTES 59 SECONDS WEST A DISTANCE OF 128.292 FEET TO A POINT OF
    13  CURVE; THENCE BY AN ARC OF A CIRCLE DEFLECTING TO THE LEFT,
    14  HAVING A RADIUS OF 25.000 FEET AND A CENTRAL ANGLE OF 90 DEGREES
    15  FOR AN ARC DISTANCE OF 39.270 FEET TO A POINT OF TANGENT ON THE
    16  SOUTHERLY LINE OF WESTHALL STREET; THENCE WESTWARDLY ALONG SAID
    17  SOUTHERLY LINE OF WESTHALL STREET SOUTH 87 DEGREES 49 MINUTES 01
    18  SECONDS WEST A DISTANCE OF 151.007 FEET TO A POINT, SAID POINT
    19  BEING THE PLACE OF BEGINNING. BEING DESIGNATED IN THE DEED
    20  REGISTRY OFFICE OF ALLEGHENY COUNTY AS BLOCK 44C, LOT NO. 122.
    21     (B)  THE LAND SHALL NOT BE ACQUIRED UNTIL ITS TITLE HAS BEEN
    22  APPROVED BY THE OFFICE OF ATTORNEY GENERAL.
    23     (C)  THE PURCHASE PRICE OF THE REAL PROPERTY SHALL BE PAID
    24  FROM THE GENERAL OPERATING BUDGET OF THE DEPARTMENT OF
    25  CORRECTIONS.
    26     Section 2 3.  This act shall take effect immediately.          <--
