AN ACT 1 Amending the act of December 19, 1988 (P.L.1262, No.156), 2 entitled "An act providing for the licensing of clubs to 3 conduct games of chance, for the licensing of persons to 4 distribute games of chance, for the registration of 5 manufacturers of games of chance, and for suspensions and 6 revocations of licenses and permits; requiring records; 7 providing for local referendum by electorate; and prescribing 8 penalties," further providing for local option referenda. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 14(a) of the act of December 19, 1988 12 (P.L.1262, No.156), known as the Local Option Small Games of 13 Chance Act, is amended to read: 14 Section 14. Local option. 15 (a) Election to be held.--In any municipality, an election 16 may be held on the date of [the] a primary, MUNICIPAL OR GENERAL <-- 17 election [immediately preceding any municipal election, but not 18 more than once in four years,] to determine the will of the 19 electors with respect to the issuance of licenses within the
1 limits of such municipality under the provisions of this act. 2 [Where an election shall have been held at the primary election 3 preceding a municipal election in any year, another election may 4 be held under the provisions of this act at the primary election 5 occurring the fourth year after such prior election.] Whenever 6 electors equal to at least 25% of the highest vote cast for any 7 office in the municipality at the last preceding general 8 election shall file a petition with the county board of 9 elections of the county, or the governing body of the 10 municipality adopts, by a majority vote, a resolution to place 11 such a question on the ballot and a copy of the resolution is 12 filed with the board of elections of the county, for a 13 referendum on the question of issuing licenses, the county board 14 of elections shall cause a question to be placed on the ballot 15 or on the voting machine board and submitted at [the] a NEXT <-- 16 FOLLOWING primary, MUNICIPAL OR GENERAL election [immediately <-- 17 preceding the municipal election].
