                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further prohibiting the sale of
     3     tobacco; and prohibiting the furnishing of free coupons for
     4     cigarettes or free samples of cigarettes.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6305 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 6305.  Sale of tobacco.
    10     A person is guilty of a summary offense if he sells tobacco,
    11  in any form, including, but not limited to, chewing tobacco and
    12  snuff, to any minor under the age of [16] 18 years, or by
    13  purchase, gift or other means, furnishes tobacco, in any form,
    14  including, but not limited to, chewing tobacco and snuff, to a
    15  minor under the age of [16] 18 years.
    16     Section 2.  Title 18 is amended by adding a section to read:
    17  § 7326.  Furnishing cigarette coupons or samples.
    18     (a)  Offense defined.--A person commits a summary offense if


     1  he furnishes any person with free samples of cigarettes or
     2  coupons to obtain free cigarettes.
     3     (b)  Penalties.--A person who violates this section shall,
     4  upon conviction, be sentenced to pay a fine of not less than $50
     5  nor more than $300 or to imprisonment for not more than 90 days,
     6  or both.
     7     Section 3.  This act shall take effect in 60 days.
