        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MARCH 14, 1990

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for removal of vehicle from
     3     property and notice to owner and lienholders of abandoned
     4     vehicles.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 3353(c) and, 7305(b)(3) AND 7307 of       <--
     8  Title 75 of the Pennsylvania Consolidated Statutes are amended
     9  to read:
    10  § 3353.  Prohibitions in specified places.
    11     * * *
    12     (c)  Property owner may remove vehicle.--The owner or other
    13  person in charge or possession of any property on which a
    14  vehicle is parked or left unattended in violation of the
    15  provisions of subsection (b) may remove or have removed the
    16  vehicle at the reasonable expense of the owner of the vehicle.
    17  [Such] Prior to removal of the vehicle, the condition of the


     1  vehicle must be certified by the police department OR BY          <--
     2  PERSONNEL DESIGNATED BY ORDINANCE OF THE MUNICIPALITY on a form
     3  prescribed by the department. The person who removes or has
     4  removed a vehicle left parked or unattended in violation of the
     5  provisions of subsection (b) shall have a lien against the owner
     6  of the vehicle[,] in the amount of the reasonable value of the
     7  costs of removing the vehicle plus the costs of storage. Any
     8  city, borough, incorporated town or township may, by ordinance,
     9  provide for rates to be charged for removal of vehicles and for
    10  municipal regulation of authorized towing services. If storage
    11  charges are not set by the municipality, a maximum of $8 per day
    12  may be charged.

    14  § 7305.  Notice to owner and lienholders of abandoned vehicles.
    15     * * *
    16     (b)  Contents of notice.--The notice shall:
    17         * * *
    18         (3)  Inform the owner and any lienholders of their right
    19     to reclaim the vehicle within 30 days after the date of the
    20     notice at the place where the vehicle is being held by the
    21     salvor, upon payment of all towing and storage charges and
    22     the fee authorized in section 7306 (relating to payment of
    23     costs upon reclaiming vehicle). The 30-day period shall be
    24     reduced to 20 days if there is no lienholder and the
    25     provisions of section 3352(d) were followed.

    27  § 7307.  AUTHORIZATION FOR DISPOSAL OF UNCLAIMED VEHICLES.        <--
    28     THE DEPARTMENT SHALL, AFTER THE EXPIRATION OF 30 DAYS FROM
    29  THE DATE OF NOTICE SENT BY CERTIFIED MAIL TO THE REGISTERED
    30  OWNER AND ALL LIENHOLDERS OF RECORD, 20 DAYS AFTER THE DATE OF

     1  NOTICE SENT BY CERTIFIED MAIL ONLY TO THE REGISTERED OWNER OR 30
     2  DAYS AFTER PUBLICATION OF NOTICE, [WHERE] AS APPLICABLE, AND
     3  UPON RECEIPT OF A WRITTEN STATEMENT FROM THE HOLDER OF THE
     4  VEHICLE THAT THE ABANDONED VEHICLE HAS NOT BEEN RECLAIMED BY THE
     5  OWNER OR LIENHOLDER WITHIN THE [30-DAY] APPLICABLE PERIOD,
     6  AUTHORIZE THE DISPOSAL OF THE ABANDONED VEHICLE IN ACCORDANCE
     7  WITH THE PROVISIONS OF THIS CHAPTER.
     8     Section 2.  This act shall take effect in 60 days.
