                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for removal of vehicle from
     3     property and notice to owner and lienholders of abandoned
     4     vehicles.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 3353(c) and 7305(b)(3) of Title 75 of
     8  the Pennsylvania Consolidated Statutes are amended to read:
     9  § 3353.  Prohibitions in specified places.

    11     (c)  Property owner may remove vehicle.--The owner or other
    12  person in charge or possession of any property on which a
    13  vehicle is parked or left unattended in violation of the
    14  provisions of subsection (b) may remove or have removed the
    15  vehicle at the reasonable expense of the owner of the vehicle.
    16  [Such] Prior to removal of the vehicle, the condition of the
    17  vehicle must be certified by the police department on a form
    18  prescribed by the department. The person who removes or has

     1  removed a vehicle left parked or unattended in violation of the
     2  provisions of subsection (b) shall have a lien against the owner
     3  of the vehicle[,] in the amount of the reasonable value of the
     4  costs of removing the vehicle plus the costs of storage. Any
     5  city, borough, incorporated town or township may, by ordinance,
     6  provide for rates to be charged for removal of vehicles and for
     7  municipal regulation of authorized towing services. If storage
     8  charges are not set by the municipality, a maximum of $8 per day
     9  may be charged.

    11  § 7305.  Notice to owner and lienholders of abandoned vehicles.

    13     (b)  Contents of notice.--The notice shall:
    14         * * *
    15         (3)  Inform the owner and any lienholders of their right
    16     to reclaim the vehicle within 30 days after the date of the
    17     notice at the place where the vehicle is being held by the
    18     salvor, upon payment of all towing and storage charges and
    19     the fee authorized in section 7306 (relating to payment of
    20     costs upon reclaiming vehicle). The 30-day period shall be
    21     reduced to 20 days if there is no lienholder and the
    22     provisions of section 3352(d) were followed.

    24     Section 2.  This act shall take effect in 60 days.
