                                     AN ACT

     1  Prohibiting the use of public or subsidized housing and
     2     subsidized mortgage assistance by persons convicted of
     3     felonies relating to controlled substances.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Use of public housing by certain felons prohibited.
     7     (a)  Housing agencies.--It shall be unlawful for any agency
     8  or authority of the Commonwealth or of a political subdivision
     9  which owns or operates any form of public or subsidized
    10  residential housing to lease or to renew a lease of a housing
    11  unit to, or to allow the continued occupancy of, a housing unit
    12  by, any person convicted of a felony under the act of April 14,
    13  1972 (P.L.233, No.64), known as The Controlled Substance, Drug,
    14  Device and Cosmetic Act, or a similar act of another state.
    15     (b)  Tenants.--It shall be unlawful for any person convicted
    16  of a felony, as described in subsection (a), to lease any unit


     1  of public or subsidized housing owned or operated by the
     2  Commonwealth or a political subdivision or any agency or
     3  authority thereof, and any tenant occupying a housing unit in
     4  violation of this section shall be immediately evicted.
     5  Section 2.  Subsidized mortgage assistance.
     6     No person convicted of a felony as described in section 1(a)
     7  shall be eligible to receive any subsidized mortgage assistance
     8  from any agency or authority of the Commonwealth or of a
     9  political subdivision.
    10  Section 3.  Effective date.
    11     This act shall take effect in 60 days.
