                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, requiring human immunodeficiency virus
     3     (HIV) testing for persons convicted of sexual offenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3129.  Testing requirement of human immunodeficiency virus
     9             (HIV).
    10     Any person convicted of a violation of this chapter 31 which
    11  involves transmission of bodily fluids shall be ordered by the
    12  court to be tested for the presence of human immunodeficiency
    13  virus (HIV) infection. If a person tests positive, the victim
    14  shall be notified and referred to the Department of Health for
    15  counseling.
    16     Section 2.  This act shall take effect immediately.
