                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, increasing the penalty for scattering
     3     rubbish.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6501 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6501.  Scattering rubbish.
     9     (a)  Offense defined.--A person is guilty of an offense if
    10  he:
    11         (1)  throws any waste paper, sweepings, ashes, household
    12     waste, glass, metal, refuse or rubbish, or any dangerous or
    13     detrimental substance into or upon any road, street, highway,
    14     or alley, or upon the land of another or into or upon any
    15     stream or navigable river;
    16         (2)  interferes with, scatters[,] or disturbs the
    17     contents of any receptacle containing ashes, garbage,
    18     household waste, or rubbish; or

     1         (3)  is the operator of a trash, garbage or debris
     2     collection vehicle or any other type of vehicle used for
     3     collecting trash, garbage or debris and deposits the
     4     vehicle's load or any part thereof upon any road, street,
     5     highway or alley or upon the land of another.
     6     (b)  Penalty.--
     7         (1)  A person who violates subsection (a)(1) or (2) [is
     8     guilty of] with less than 20 gallons of material prohibited
     9     by this section commits a summary offense and, upon
    10     conviction [thereof], shall be sentenced to pay a fine of not
    11     less than [$10] $50 nor more than [$300] $1,000 or to
    12     imprisonment for not more than 90 days, or both.
    13         (2)  A person who violates subsection (a)(1) or (2) with
    14     more than 20 gallons of material prohibited by this section
    15     or with a container with a capacity of 20 gallons or more
    16     containing material prohibited by this section commits a
    17     misdemeanor of the third degree.
    18         [(2)] (3)  A person who violates subsection (a)(3) [is
    19     guilty of] commits a misdemeanor of the third degree for the
    20     first offense, a misdemeanor of the second degree for the
    21     second offense and a misdemeanor of the first degree for the
    22     third or any subsequent offense.
    23     (c)  Disposition of fines.--(Repealed).
    24     (d)  Exception.--Subsection (a)(3) does not apply to the
    25  lawful depositing of waste at any site regulated by the
    26  Department of Environmental Resources.
    27     Section 2.  This act shall take effect immediately.
