AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, requiring certain evidence to
3 substantiate violations relating to purchase, consumption,
4 possession or transportation of liquor or malt or brewed
5 beverages by minors.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Section 6308 of Title 18 of the Pennsylvania
9 Consolidated Statutes is amended by adding a subsection to read:
10 § 6308. Purchase, consumption, possession or transportation of
11 liquor or malt or brewed beverages.

13 (e) Evidence.--The mere presence of a minor in or on
14 premises where any liquor or malt or brewed beverage is in the
15 possession of or being consumed by another person, or in a
16 vehicle in which any liquor or malt or brewed beverage is in the
17 possession of or is being transported by another person shall
1 not be sufficient evidence for a conviction or adjudication or
2 other preadjudicative disposition under this section.
3 Section 2. This act shall take effect immediately.
