                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, providing for the recomputation of
     3     annuities in certain cases relating to decedent survivor
     4     annuitants.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 5907(j) of Title 71 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 5907.  Rights and duties of State employees and members.

    11     (j)  Nomination of beneficiary or survivor annuitant.--A
    12  member who is eligible and elects to receive a reduced annuity
    13  under Option 1, 2, 3, or 4, shall nominate a beneficiary or a
    14  survivor annuitant, as the case may be, by written designation
    15  filed with the board at the time of his retirement. A member who
    16  has elected Option 1 may change his designated beneficiary at
    17  any time. A member having designated a survivor annuitant at the
    18  time of retirement shall not be permitted to nominate a new


     1  survivor annuitant unless such survivor annuitant predeceases
     2  him or unless the member is awarded a divorce or becomes married
     3  subsequent to the election of the option. In such cases, the
     4  annuitant shall have the right to reelect an option and to
     5  nominate a beneficiary or a new survivor annuitant and to have
     6  his annuity recomputed to be actuarially equivalent as of the
     7  date of recomputation to the annuity in effect immediately prior
     8  to the recomputation. In a case where a survivor annuitant
     9  predeceases a member, the member shall have the right to have
    10  his annuity recomputed to an amount he would have received had
    11  he not designated a survivor annuitant. This recomputation shall
    12  date from the time his application for such recomputation is
    13  received by the board. In no other case shall a benefit plan be
    14  changed by an annuitant.
