                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for proof of financial responsibility
     3     upon registration or renewal and for reports of insurance
     4     cancellations to the Department of Transportation, the
     5     Pennsylvania State Police and local police.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1786 of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 1786.  [Self-certification of financial responsibility] Proof
    11             of financial responsibility upon registration and
    12             renewal.
    13     The Department of Transportation shall require that each
    14  motor vehicle registrant [certify that the registrant is
    15  financially responsible] provide proof of financial
    16  responsibility at the time of registration or renewal thereof.


     1  The department shall refuse to register or renew the
     2  registration of a vehicle for failure to comply with this
     3  requirement or [falsification of self-certification] for
     4  providing false information.
     5     Section 2.  Title 75 is amended by adding a section to read:
     6  § 1788.  Obligations upon termination of insurance.
     7     (a)  Notice required.--An insurer which has issued a contract
     8  of motor vehicle liability insurance and knows or has reason to
     9  believe that the contract is for the purpose of providing
    10  financial responsibility, shall immediately notify the
    11  Department of Transportation if the insurance is canceled or
    12  terminated by the insured or by the insurer. The insurer shall
    13  so notify the department not later than ten days following the
    14  effective date of the cancellation or termination. This
    15  requirement shall not apply to a policy which has been in effect
    16  for more than six months from the date the policy was initially
    17  issued.
    18     (b)  Form of notice.--The notice of cancellation or
    19  termination of motor vehicle liability insurance coverage shall
    20  be provided by the insurer in the manner prescribed in
    21  department regulations.
    22     (c)  Notice to policyholder.--After receipt of the notice of
    23  cancellation or termination by the department, the department
    24  shall notify the policyholder that his vehicle registration will
    25  be suspended unless he provides the department with evidence of
    26  financial responsibility within ten days of the date printed on
    27  the notice.
    28     (d)  Suspension of vehicle registration.--Upon failure of the
    29  owner to provide the department with the required evidence of
    30  financial responsibility, the department shall:

     1         (1)  Suspend the registration of the vehicle or vehicles
     2     for which the owner has ceased to maintain financial
     3     responsibility after first giving the owner written notice.
     4         (2)  Notify the Pennsylvania State Police of the
     5     suspension of the vehicle registration or registrations, and
     6     the Pennsylvania State Police shall notify the appropriate
     7     local police.
     8     Section 3.  This act shall take effect in six months.
