AN ACT
1 Amending Title 40 (Insurance) of the Pennsylvania Consolidated
2 Statutes, adding provisions relating to actions of
3 administrative agencies for professional health service
4 corporations and standing to participate.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Chapter 63 of Title 40 of the Pennsylvania
8 Consolidated Statutes is amended by adding a subchapter to read:

17 § 6341. Rate and contract participation.
18 (a) Notice of hearings.--All decisions, rulings,
1 adjudications, approvals and other actions of the Department of
2 Health and the Insurance Department, relating to the activities
3 of a professional health service corporation involving a dental
4 plan, shall be made only after publication in the Pennsylvania
5 Bulletin of notice of opportunity for hearing.
6 (b) Standing.--Any dentist or dentists personally aggrieved
7 by a proposed action of a professional health service
8 corporation involving a dental plan or any State or local
9 professional dental society shall be deemed a full party in
10 interest and have standing and a right to participate in any
11 proceeding under this chapter and shall have the right upon
12 request to a formal administrative hearing.
13 Section 2. This act shall take effect immediately.
