                                     AN ACT

     1  Amending the act of May 18, 1937 (P.L.654, No.174), entitled, as
     2     amended, "An act to provide for the safety and to protect the
     3     health and morals of persons while employed; prescribing
     4     certain regulations and restrictions concerning places where
     5     persons are employed, and the equipment, apparatus,
     6     materials, devices and machinery used therein; prescribing
     7     certain powers and duties of the Department of Labor and
     8     Industry relative to the enforcement of this act; and fixing
     9     penalties," further providing for general safety and health
    10     requirements.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 2 of the act of May 18, 1937 (P.L.654,
    14  No.174), entitled, as amended, "An act to provide for the safety
    15  and to protect the health and morals of persons while employed;
    16  prescribing certain regulations and restrictions concerning
    17  places where persons are employed, and the equipment, apparatus,
    18  materials, devices and machinery used therein; prescribing
    19  certain powers and duties of the Department of Labor and
    20  Industry relative to the enforcement of this act; and fixing
    21  penalties," amended or added July 13, 1953 (P.L.438, No.97) and


     1  October 7, 1976 (P.L.1107, No.225), is amended to read:
     2     Section 2.  General Safety and Health Requirements.--(a)  All
     3  establishments shall be so constructed, equipped, arranged,
     4  operated, and conducted as to provide reasonable and adequate
     5  protection for the life, limb, health, safety, and morals of all
     6  persons employed therein.
     7     (b)  All belts, pulleys, gears, chains, sprockets, shafting,
     8  and other mechanical power transmission apparatus, stationary
     9  engines, electrical equipment, and apparatus shall be properly
    10  guarded to protect workers from injury.
    11     (c)  All cranes, hoists, steam or electric shovels, plant
    12  railroads, and other apparatus or devices used for moving,
    13  lifting, lowering, and transporting material shall be designed,
    14  constructed, equipped, and operated as to eliminate dangerous
    15  conditions.
    16     (d)  The point of operation on all saws, planers, jointers or
    17  other power driven woodworking machines and all power presses,
    18  planers, shapers, and other power driven machine tools, and
    19  dangerous parts of any other machines or devices shall be
    20  provided with guards of a type approved by the department.
    21  Laundry machines, extractors, washers, ironers, and other
    22  machines or apparatus shall be provided with guards where,
    23  because of accident hazard, they are required by the department.
    24     (e)  All toxic and noxious dusts, fumes, vapors, gases,
    25  fibers, fogs, mists or other atmospheric impurities, created in
    26  connection with any manufacturing process, emitted into or
    27  disseminated throughout areas where persons are employed in such
    28  quantities as, in the opinion of the department, would injure
    29  the health of employes or create other dangerous conditions,
    30  shall be removed at the point of origin, or, where this is

     1  impractical, personal protective devices, including surgical
     2  masks, shall be provided and worn by persons subjected to such
     3  hazards.
     4     (f)  All pits, quarries, mines other than coal mines,
     5  trenches, excavations, and similar operations shall be properly
     6  shored, braced, and otherwise guarded, operated, and conducted
     7  as to provide reasonable and adequate protection to workers
     8  employed therein.
     9     (g)  All building construction, demolition, and cleaning,
    10  including window cleaning, shall be conducted in a manner as to
    11  avoid accident hazards to workers or the public. Scaffolds,
    12  ladders, material hoists, window cleaning devices, safety belts,
    13  and other equipment used in such operations, shall be designed,
    14  manufactured, constructed, and erected as to be safe for the
    15  purpose intended. All stairs, open-sided floors, platforms, and
    16  runways shall be provided with proper railings and toe-boards.
    17     (h)  When employes, due to the nature of employment, are
    18  subject to injury from flying particles, falling objects, sharp
    19  or rough surfaces or materials, hot, corrosive or poisonous
    20  substances, acids or caustics and injurious light rays or
    21  harmful radioactive materials, they shall be provided with and
    22  shall wear goggles, other head and eye protectors, gloves,
    23  leggings, and other personal protective devices.
    24     (i)  All plant, scenic or other railroad operations other
    25  than those common carrier railroads presently subject to the
    26  jurisdiction of the Public Utility Commission shall be
    27  maintained and operated in such a manner as to prevent
    28  unreasonable or unnecessary hazards to workers or the public.
    29  Motive power, rolling stock, and roadbeds shall be designed,
    30  manufactured and maintained so as to be safe for its intended

     1  purpose and provide maximum safety to the public and the
     2  employes involved.
     3     Section 2.  This act shall take effect in 60 days.
