           TRELLO, GIGLIOTTI, VAN HORNE, BILLOW, STABACK AND DALEY,
           APRIL 3, 1989

        AS REPORTED FROM COMMITTEE ON GAME AND FISHERIES, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 13, 1989

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, further providing for the collective bargaining
     3     status of Pennsylvania Fish Commission officers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 304 of Title 30 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 304.  Waterways patrolmen and employees.
     9     (a)  Appointment and compensation.--The executive director,
    10  with the approval of the commission, shall, in accordance with
    11  law, appoint and fix the compensation of such number of
    12  waterways patrolmen and other employees as the commission deems
    13  necessary to enforce and carry out the provisions of this title
    14  and perform the functions and work of the commission.
    15     (b)  Status.--[This title does not change the status of
    16  waterways patrolmen for the purposes of the act of July 23, 1970
    17  (P.L.563, No.195), known as the "Public Employe Relations Act,"

     1  or cause waterways patrolmen to be considered policemen for the
     2  purposes of the act of June 24, 1968 (P.L.237, No.111), referred
     3  to as the Policemen and Firemen Collective Bargaining Act.] For
     4  the purposes of collective bargaining and compensation for work-
     5  related injuries, salaried waterways patrolmen FULL-TIME          <--
     6  SALARIED WATERWAYS CONSERVATION OFFICERS shall be deemed
     7  policemen for the purposes of the act of June 28, 1935 (P.L.477,
     8  No.193), referred to as the Enforcement Officer Disability
     9  Benefits Law, and the act of June 24, 1968 (P.L.237, No.111),
    10  referred to as the Policemen and Firemen Collective Bargaining
    11  Act.
    12     Section 2.  This act shall take effect in 60 days JULY 1,      <--
