                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for special aid to
     6     school districts suffering loss of revenue due to bankruptcy
     7     of businesses in the school district.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2502.16(a) of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949, added
    12  July 10, 1987 (P.L.286, No.50), is amended to read:
    13     Section 2502.16.  Temporary Special Aid to School Districts
    14  Suffering Loss of Tax Revenue Due to Bankruptcy of Businesses in
    15  the School District.--(a)  For the school year 1985-1986 and
    16  each school year thereafter, a school district experiencing [a
    17  ten percent (10%)] an eight percent (8%) or greater loss in
    18  revenue from real estate taxes for the support of the public
    19  schools in any one school year, compared with real estate tax

     1  collections the previous year, due to the nonpayment of such
     2  taxes within sixty (60) days of the due date for the payment of
     3  such taxes during such school year or during the preceding
     4  school year by any businesses owning real estate within the
     5  boundaries of such school district, by reason of bankruptcy
     6  proceedings under Chapter 7, 11 or 13 of the Bankruptcy Code (11
     7  U.S.C. § 101 et seq.) shall qualify for temporary special aid
     8  under the provisions of this section for a period of two years
     9  as provided for in subsection (b).

    11     Section 2.  This act shall be retroactive to July 1, 1988.
    12     Section 3.  This act shall take effect immediately.
