                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," further
     4     providing for tax levies; and making a repeal.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1302(8) of the act of February 1, 1966
     8  (1965 P.L.1656, No.581), known as The Borough Code, is amended
     9  to read:
    10     Section 1302.  Tax Levy.--The council of the borough shall
    11  have power, by ordinance, to levy and collect annually, a tax,
    12  not exceeding thirty mills for general borough purposes, unless
    13  the council by majority action shall, upon due cause shown by
    14  resolution, petition the court of common pleas, in which case
    15  the court may order a rate of not more than five mills
    16  additional to be levied and in addition thereto any of the
    17  following taxes:

    19     (8)  To establish and/or maintain a local library or to

     1  maintain or aid in the maintenance of a local library
     2  established by deed, gift or testamentary provision, for the use
     3  of the residents of the borough, [not exceeding three mills,]
     4  such additional millage permitted only following a favorable
     5  referendum on the matter held in accordance with the act of June
     6  14, 1961 (P.L.324, No.188), known as The Library Code.

     8     Section 2.  The act of June 14, 1961 (P.L.324, No.188), known
     9  as The Library Code, is repealed to the extent that it limits
    10  the library tax levied by a borough council to three mills.
    11     Section 3.  This act shall take effect in 60 days.
