                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," requiring certain purchases
    21     to be made from domestic bidders; and making editorial
    22     changes.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  Section 2403(c) and (g) of the act of April 9,
    26  1929 (P.L.177, No.175), known as The Administrative Code of
    27  1929, amended June 21, 1937 (P.L.1865, No.373) and June 12, 1951


     1  (P.L.516, No.133), are amended to read:
     2     Section 2403.  Standards and Purchases.--The Department of
     3  General Services shall have the power, and its duty shall be:
     4     * * *
     5     (c)  To enter into contracts with the lowest responsible
     6  domestic bidder for the purchase of all other furniture,
     7  materials or supplies requested by the Legislative, and other
     8  departments of the State Government, except as otherwise
     9  provided by this act, and except that contracts for the purchase
    10  of steel for use in the manufacture of vehicle registration
    11  plates may be let on the basis of the market price thereof on
    12  date of delivery. All such contracts shall be approved by the
    13  Governor, and signed on behalf of the Commonwealth by the
    14  Secretary of [Property and Supplies] General Services, who shall
    15  also, with the approval of the [Department of Justice] Attorney
    16  General, prescribe rules and regulations for the submission of
    17  bids, awards, forms of contracts and other matter related
    18  thereto. As used in this section, the term "domestic bidder"
    19  means an individual, corporation, trust, partnership, limited
    20  partnership, incorporated or unincorporated association or other
    21  entity doing business in the United States of America that
    22  supplies goods produced by human or mechanical effort where at
    23  least fifty per centum (50%) of the cost of its material or
    24  component parts were produced, manufactured or assembled in the
    25  United States of America.

    27     (g)  To authorize any other department, or any board or
    28  commission, to make direct purchases in the field, not exceeding
    29  a specified amount, but the department shall require records of
    30  all such purchases to be transmitted to it periodically in such

     1  form as it may prescribe. In so far as practicable, purchases
     2  under this paragraph shall be made from contractors having
     3  effective supplies contracts with the Department of [Property
     4  and Supplies] General Services, and shall be in accordance with
     5  applicable specifications in such contracts, otherwise such
     6  purchases shall be made from the lowest of at least two bidders.
