AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, prohibiting the transportation or
3 possession of alcoholic beverages in public places.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 5505.1. Possession of open container of alcoholic beverage.
9 (a) Offense defined.--No person shall transport or possess
10 on his person or consume any alcoholic beverage in an open
11 container in or upon public streets, sidewalks, alleys or public
12 ways, nor shall any person possess or consume an alcoholic
13 beverage in an open container in or upon the property of another
14 unless that person is a guest, licensee or invitee of the owner
15 or occupier of the property.
16 (b) Grading.--A violation of this section constitutes a
17 summary offense.
18 Section 2. This act shall take effect in 60 days.
