HOUSE BILL

        INTRODUCED BY MANDERINO, TANGRETTI, KUKOVICH, PETRARCA, SALOOM,
           VAN HORNE AND STAIRS, FEBRUARY 1, 1989

        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 13, 1989

                                     AN ACT

     1  Authorizing and directing the Department of General Services and
     2     the General State Authority, with the approval of the
     3     Governor, to convey to Westmoreland County a tract of land
     4     situate in Hempfield Township, Westmoreland County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services and the
     8  General State Authority, OR ITS SUCCESSOR IN INTEREST, with the   <--
     9  approval of the Governor, are hereby authorized and directed on
    10  behalf of the Commonwealth of Pennsylvania, to sell and convey
    11  to the County of Westmoreland, for a consideration of one-half
    12  of the fair market value, as determined by an appraisal approved
    13  by the Department of General Services, the following tract of
    14  land situate in Hempfield Township, Westmoreland County,
    15  Pennsylvania, bounded and described as follows:
    16     Starting at a point in the center line of Pennsylvania State
    17  Route 119 said point being the eastern most corner of the
    18  General State Authority (Regional 5 Prison) property and the

     1  southern most corner of the Westmoreland County Housing
     2  Authority (Hempfield Manor High Rise) property; thence north 22
     3  degrees 06 minutes 28 seconds west a distance of 403.37 feet to
     4  an iron pin, the place of beginning. Thence south 67 degrees 57
     5  minutes 32 seconds west a distance of 130.00 feet to an iron
     6  pin, thence north 67 degrees 06 minutes 28 seconds west a
     7  distance of 226.27 feet to an iron pin, thence north 22 degrees
     8  06 minutes 27 seconds west a distance of 444.64 feet to an iron
     9  pin, thence north 67 degrees 06 minutes 28 53 MINUTES 32 seconds  <--
    10  east a distance of 120.00 feet to an iron pin, thence north 22
    11  degrees 06 minutes 28 seconds west a distance of 550.00 feet to
    12  an iron pin, thence north 36 degrees 06 minutes 14 seconds east
    13  a distance of 200.00 feet to an iron pin, thence south 22
    14  degrees 06 minutes 28 seconds east a distance of 1,260.00 feet
    15  to an iron pin the point of beginning, containing 6.08 acres
    16  more or less.
    17     Section 2.  The conveyance shall be made under and subject to
    18  all easements, servitudes and rights of others, including, but
    19  not confined to, streets, roadways and rights of any telephone,
    20  telegraph, water, electric, sewer, gas or pipeline companies, as
    21  well as under and subject to any interest, estates or tenancies
    22  vested in third persons, whether or not appearing of record, for
    23  any portion of the land or improvements erected thereon.
    24     SECTION 3.  THE DEED OF CONVEYANCE SHALL CONTAIN A CLAUSE      <--
    25  THAT THE PROPERTY CONVEYED SHALL BE USED FOR COUNTY GOVERNMENT
    26  FUNCTIONS BY WESTMORELAND COUNTY, AND, IF AT ANY TIME
    27  WESTMORELAND COUNTY OR ITS SUCCESSOR IN FUNCTION SELLS OR
    28  TRANSFERS THE PROPERTY OR PERMITS THE PROPERTY TO BE USED FOR
    29  ANY PURPOSE OTHER THAN THOSE SPECIFIED IN THIS SECTION, THE
    30  TITLE TO THE PROPERTY SHALL IMMEDIATELY REVERT TO AND REVEST IN

     1  THE COMMONWEALTH OF PENNSYLVANIA.
     2     Section 3 4.  The deed of conveyance shall be approved as      <--
     3  provided by law and shall be executed by the President and
     4  Secretary of the General State Authority, OR THE OFFICIALS OF     <--
     5  ITS SUCCESSOR IN INTEREST, and by the Secretary of General
     6  Services in the name of the Commonwealth of Pennsylvania.
     7     Section 4 5.  Costs and fees incidental to this conveyance     <--
     8  shall be borne by the grantee.
     9     Section 5 6.  This act shall take effect immediately.          <--
