                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for limitations on passengers who
     3     may be carried on motorcycles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3522 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3522.  Riding on motorcycles.
     9     (a)  Use of seat by operator and passengers.--A person
    10  operating a motorcycle shall ride only upon the permanent and
    11  regular seat attached to the motorcycle, and the operator shall
    12  not carry any other person nor shall any other person ride on a
    13  motorcycle unless the motorcycle is designed to carry more than
    14  one person, in which event a passenger may ride upon the
    15  permanent and regular seat if designed for two persons, or upon
    16  another seat firmly attached to the motorcycle at the rear or
    17  side of the operator. In no event shall a passenger sit in front
    18  of the operator of the motorcycle.

     1     (b)  Method of seating.--Unless in a sidecar, a person shall
     2  ride upon a motorcycle only while sitting astride the seat,
     3  facing forward, with one leg on each side of the motorcycle. In
     4  no event shall a person ride upon a motorcycle astride a seat
     5  unless his legs are of sufficient length to reach the pegs or
     6  footrests installed by the manufacturer for passengers' feet.
     7     (c)  Articles carried by operator.--No person shall operate a
     8  motorcycle while carrying any package, bundle or other article
     9  which prevents him from keeping both hands on the handlebars.
    10     (d)  Interference with operation.--No operator shall carry
    11  any person, nor shall any person ride, in a position that will
    12  interfere with the operation or control of the motorcycle or the
    13  view of the operator.
    14     Section 2.  This act shall take effect in 60 days.
