                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting riding in cargo areas.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 3711 of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 3711.  Unauthorized persons and devices hanging on vehicles or
     8             riding in cargo area.
     9     (a)  General rule.--No person shall hang onto or ride on the
    10  outside or the rear end of any vehicle and no person on a
    11  pedalcycle, motorcycle, roller skates, sled or any similar
    12  device, shall hold fast to or attach the device to any moving
    13  vehicle or streetcar, and no operator of a vehicle or streetcar
    14  shall knowingly permit any person to hang onto or ride on the
    15  outside or rear end of the vehicle or streetcar operated, or
    16  allow any person on a pedalcycle, motorcycle, roller skates,
    17  sled or any similar device to hold fast or attach the device to

     1  the vehicle or streetcar operated on any highway.
     2     (b)  Riding in cargo area.--No person under 12 years of age
     3  shall ride in the cargo area of a Class 1 truck, other than a
     4  farm truck, when that truck is being operated on any highway. No
     5  operator of a Class 1 truck, other than a farm truck, shall
     6  knowingly permit any person under 12 years of age to ride in the
     7  cargo area of such a truck when that truck is being operated on
     8  any highway.
     9     [(b)] (c)  Exceptions.--This section is not applicable to
    10  firemen or garbage collectors or operators of fire trucks or
    11  garbage trucks or employees of public utility companies acting
    12  pursuant to and during the course of their duties or to other
    13  persons exempted by department regulations from the application
    14  of this section. This section does not prohibit attaching a
    15  trailer or semitrailer to a pedalcycle.
    16     Section 2.  This act shall take effect in 60 days.
