AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, providing for the issuance of free hunting licenses 3 to certain parties who open land to public hunting. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 2706 of Title 34 of the Pennsylvania 7 Consolidated Statutes is amended by adding a subsection to read: 8 § 2706. Resident license and fee exemptions. 9 * * * 10 (d) Owners or possessors of land open to public hunting.--An 11 owner or possessor of land which would otherwise qualify for 12 preferential assessment under the act of December 19, 1974 13 (P.L.973, No.319), known as the Pennsylvania Farmland and Forest 14 Land Assessment Act of 1974, shall, if he permits public hunting 15 on such land, upon application to the county treasurer of the 16 county in which such land is primarily located be entitled to 17 receive annually up to two regular hunting licenses without 18 payment of license fees: Provided, however, That no more than
1 two free hunting licenses shall be annually issued for each 2 tract of land eligible for license issue nor shall any person be 3 entitled to receive more than two free licenses annually under 4 this subsection: And provided further, That where possession of 5 the land tract differs from ownership, possession shall 6 determine the eligibility of persons entitled to the benefits 7 provided in this subsection unless otherwise agreed between the 8 owner and the possessor. The licenses shall be issued to the 9 owner or possessor and an immediate family member so designated 10 by such owner or possessor in the case of a single owner or 11 possessor, and to such owners or possessors and an immediate 12 family member of such owners or possessors so agreed to and 13 designated in the case of more than one owner or possessor. No 14 person shall be issued a hunting license under this subsection 15 unless such person is at least 12 years of age, has met the 16 requirements prescribed in section 2704 (relating to eligibility 17 for license), and has not been denied the privilege to hunt. A 18 person entitled to receive hunting licenses under this 19 subsection shall certify to the commission in the form and 20 manner prescribed by the commission that the land tract he owns 21 or possesses is open to public hunting. Upon determination that 22 such person is entitled to receive hunting licenses pursuant to 23 this subsection, the commission shall signify such, in writing, 24 to such person and such writing shall be presented to the county 25 treasurer at the time of license application. Where two free 26 licenses are intended to be issued pursuant to this subsection, 27 such licenses shall be applied for and processed simultaneously. 28 Section 2. Section 2709(a) of Title 34 is amended by adding 29 a paragraph to read: 30 § 2709. License costs and fees. 19870S0865B1055 - 2 -
1 (a) License costs.--Any person who qualifies under the 2 provisions of this chapter shall be issued the applicable 3 license upon payment of the following costs and the issuing 4 agent's fee: 5 * * * 6 (19) Owners or possessors of land open to public hunting 7 under section 2706(d) (relating to owners or possessors of 8 land open to public hunting) - no cost. 9 * * * 10 Section 3.
