                                  A RESOLUTION

     1  Memorializing the Congress of the United States to direct the
     2     United States Postal Service to require, through regulation,
     3     that all pieces of mail containing sexually oriented material
     4     shall have indicated on the outside of the mailing piece in a
     5     prominent location that the mailing contains such material.

     6     WHEREAS, Historically, the United States Postal Service has
     7  been at the forefront of the Federal Government's efforts to
     8  curb the distribution by mail of unlawful adult and child
     9  pornography; and
    10     WHEREAS, The Postal Service created an awareness campaign to
    11  enlighten the American public as to how one can protect oneself
    12  from receiving unsolicited and unwanted sexually oriented
    13  advertisements (SOA) by mail; and
    14     WHEREAS, The Federal law defines a "sexually oriented
    15  advertisement" as any advertisement that depicts, in actual or
    16  simulated form, or explicitly describes, in a predominantly


     1  sexual context, human genitalia, any act of natural or unnatural
     2  sexual intercourse, any act of sadism or masochism, or any other
     3  erotic subject directly related to the foregoing; and
     4     WHEREAS, Without an explicit marking on the outside of the
     5  sexually oriented mailings, the incidence of minor children
     6  opening or even coming in contact with such material will
     7  continue to exceed acceptable levels; therefore be it
     8     RESOLVED, That the House of Representatives of the
     9  Commonwealth of Pennsylvania memorialize the Congress of the
    10  United States to direct the United States Postal Service to
    11  require, through regulation, that all pieces of mail containing
    12  sexually oriented material shall contain on the outside of the
    13  mailing piece, in a prominent location, an indication that the
    14  mailing contains such material, as follows:
    15         THIS MAILING CONTAINS SEXUALLY ORIENTED MATERIAL. YOU ARE
    16         ADVISED THAT, IN ACCORDANCE WITH TITLE 39 UNITED STATES
    17         CODE, SECTIONS 3008 AND 3010, YOU MAY CONTACT YOUR LOCAL
    18         POST OFFICE TO PROHIBIT THE FUTURE DELIVERY OF SUCH MAIL
    19         TO YOU.
    20  ; and be it further
    21     RESOLVED, That copies of this resolution be transmitted to
    22  the presiding officers of each house of Congress and to each
    23  member of Congress from Pennsylvania.
