                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for retail theft
     3     rehabilitation and community service in relation to retail
     4     theft.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3929 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended by adding subsections to read:
     9  § 3929.  Retail theft.

    11     (h)  Retail theft rehabilitation.--
    12         (1)  Every person convicted of a violation of this
    13     section or placed on Accelerated Rehabilitative Disposition
    14     or other preliminary disposition as a result of a charge of a
    15     violation of this section shall, as part of sentencing or as
    16     a condition of probation or Accelerated Rehabilitative
    17     Disposition, attend and successfully complete a retail theft


     1     rehabilitation program, if that condition is imposed by the
     2     court.
     3         (2)  Fees to cover the costs of participation in a retail
     4     theft rehabilitation program shall be in addition to any
     5     other penalty required or allowed by law and shall be the
     6     responsibility of the defendant.
     7     (i)  Community service.--In addition to any other requirement
     8  of this section, a person convicted of a violation of this
     9  section or placed on Accelerated Rehabilitative Disposition or
    10  other preliminary disposition as a result of a charge brought
    11  under this section may engage in a program of community work
    12  service or collection of litter from public and private
    13  property, if that condition is imposed by the court. The
    14  duration of the defendant's participation shall not exceed the
    15  duration of the supervision period imposed.
    16     Section 2.  This act shall take effect in 60 days.
