AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for the issuance of a junior 3 driver's license only upon completion of a standardized 4 driver's training course; and providing for special learner's 5 permits. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 1503(c) of Title 75 of the Pennsylvania 9 Consolidated Statutes is amended to read: 10 § 1503. Persons ineligible for licensing. 11 * * * 12 (c) Junior driver's license.--The department may issue a 13 junior driver's license only to a person 16 or 17 years of age 14 who has successfully completed a standardized driver's training 15 course approved by the Department of Education under rules and 16 regulations adopted by the department and subject to the 17 provisions of this section. A junior driver's license shall 18 automatically become a regular driver's license when the
1 licensee attains 18 years of age. 2 (1) Except as provided in paragraph (2), no licensed 3 junior driver shall drive a vehicle upon a public highway 4 between 12 midnight and 5 a.m. unless accompanied by a spouse 5 18 years of age or older, a parent or a person in loco 6 parentis. 7 (2) A licensed junior driver conforming to the 8 requirements of section 1507 (relating to application for 9 driver's license or learner's permit by minor) may drive a 10 vehicle upon a public highway between 12 midnight and 5 a.m. 11 between their home and their activity or employment or in the 12 course of their activity or employment if they are a member 13 of a volunteer fire company authorized by the fire chief to 14 engage in fighting fires, engaged in public or charitable 15 service or employed and they are carrying an affidavit signed 16 by their fire chief, supervisor or employer indicating the 17 probable schedule of their activities. Upon termination of 18 the junior driver's activity or employment, the junior 19 licensee shall surrender the affidavit to the fire chief, 20 supervisor or employer. If the junior licensee shall fail to 21 surrender the affidavit, the employer, fire chief or 22 supervisor shall immediately notify the Pennsylvania State 23 Police. 24 (3) In addition to the other provisions of this title 25 relating to the suspension or revocation of operating 26 privileges, in the event that a licensed junior driver is 27 involved in an accident for which they are partially or fully 28 responsible in the opinion of the department or is convicted 29 of any violation of this title, the department may suspend 30 the operating privileges of such person until the person 19870H1596B1952 - 2 -
1 attains 18 years of age or for a period of time not exceeding 2 90 days. 3 (4) Any junior licensee or other person violating any 4 provision of this subsection is guilty of a summary offense. 5 Additional costs incurred by the department as a result of the 6 standardized driver's training course which exceed the amount of 7 money expended from the Motor License Fund for school district 8 reimbursement for the school year 1986-1987 shall be satisfied 9 from annual appropriations to the department from the General 10 Fund in such amounts as the General Assembly determines to be 11 appropriate. 12 Section 2. Section 1505 of Title 75 is amended by adding a 13 subsection to read: 14 § 1505. Learners' permits. 15 * * * 16 (e) Special learner's permit.--The department may issue a 17 special learner's permit to a person six months before his 16th 18 birthday. The permit may be used only during instruction 19 provided as part of a standardized driver's training course 20 approved by the Department of Education. The holder of a special 21 learner's permit is authorized to drive vehicles or combinations 22 of vehicles of the class or classes specified on the permit, but 23 only when accompanied by and under the immediate supervision of 24 a certified instructor of an approved course. A special 25 learner's permit shall be valid until the holder's 16th 26 birthday, when the department shall automatically issue him for 27 no additional fee a standard learner's permit pursuant to 28 subsections (a), (b), (c) and (d). The fee for a special 29 learner's permit shall be as provided in section 1951(e) 30 (relating to driver's license and learner's permit). 19870H1596B1952 - 3 -
1 Section 3. Section 1951 of Title 75 is amended to read: 2 § 1951. Driver's license and learner's permit. 3 (a) Driver's license.--The annual fee for a driver's license 4 shall be $5 plus the cost of the photograph required in section 5 1510(a) (relating to issuance and content of driver's license). 6 (b) Learner's permit.--The fee for a learner's permit shall 7 be $5. 8 (c) Identification card.--The fee for an identification card 9 shall be $5. 10 (d) Replacement license or card.--The fee for a replacement 11 driver's license or identification card shall be $5. 12 (e) Special learner's permit and learner's permit 13 combination.--The fee for a special learner's permit shall be 14 $5. For no additional fee, a standard learner's permit shall be 15 issued to the holder of a special learner's permit automatically 16 on his 16th birthday. 17 Section 4.
