AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, extending the provisions of a certain subsection 3 relating to credit for registration fees and exhaust emission 4 inspection costs. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 4706(f) of Title 75 of the Pennsylvania 8 Consolidated Statutes is amended to read: 9 § 4706. Prohibition on expenditures for emission inspection 10 program. 11 * * * 12 (f) Credit.-- 13 (1) Once each calendar year, every qualified person or 14 persons who owns a vehicle which undergoes an emission 15 inspection required pursuant to this section shall be 16 eligible to claim a credit in the amount of $19 against the 17 annual registration fee for the vehicle as provided in
1 Chapter 19 (relating to fees) or the processing fee in 2 section 1901(c)(16) and (17) (relating to exemption of 3 entities and vehicles from fees). The credit shall be 4 available only for one vehicle for each qualified person. 5 (2) In order to claim a credit, a qualified person shall 6 subtract the amount of the credit from the annual fee for 7 registration of the vehicle as provided in Chapter 19 or the 8 processing fee as provided in section 1901(c)(16) and (17) 9 except that the credit shall not reduce the amount of annual 10 registration fee or processing fee due to less than $5. The 11 person may only claim the credit one time in any calendar 12 year and shall claim it within 12 months of the date of the 13 inspection. 14 (3) Any qualified person who shall claim a credit under 15 this subsection is deemed to have granted his or her consent 16 for the department to have access, pursuant to procedures 17 established by the Department of Revenue and the Department 18 of Transportation, to relevant personal income tax returns. 19 Notwithstanding any other provision of law to the contrary, 20 the Department of Revenue shall provide such information 21 relating to the returns of qualified persons claiming the 22 credit as the Secretary of Transportation shall require to 23 confirm eligibility for the credit. 24 (4) Any person who fraudulently claims or attempts to 25 claim the credit as authorized herein commits a misdemeanor 26 of the second degree and shall in addition to any fines and 27 imprisonment be ordered to make restitution to the 28 Commonwealth. 29 (5) The provisions of this subsection shall expire [two 30 years from the date that the Secretary of Transportation 19870H1547B1828 - 2 -
