                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for individual transition
     6     plans for handicapped students.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1383.  Individual Transition Plans.--(a)  An
    13  individual transition plan shall be developed for all mentally,
    14  physically or multiply handicapped students as defined in the
    15  regulations and standards of the State Board of Education. The
    16  plan shall be developed within ninety (90) school days of the

     1  student's fourteenth birthday.
     2     (b)  The individual transition plan shall be developed by a
     3  multidisciplinary team which shall consist of at least one but
     4  no more than two representatives of each of the following
     5  agencies or organizations:
     6     (1)  The school district in which the student resides.
     7     (2)  The intermediate unit in which the student resides.
     8     (3)  The area vocational-technical school, if the child
     9  resides in its attendance area.
    10     (4)  The Department of Health.
    11     (5)  The Office of Mental Retardation.
    12     (6)  The Office of Mental Health.
    13     (7)  The Office of Vocational Rehabilitation.
    14     (8)  An approved private school, when the student is enrolled
    15  in the institution.
    16     (c)  If any of the agencies or organizations listed in
    17  subsection (b) are reorganized or discontinued, their successor
    18  organizations shall appoint representatives with the same
    19  responsibilities and duties.
    20     (d)  The individual transition plan shall include, but not be
    21  limited to, the following:
    22     (1)  Assessment of the student's future needs after
    23  graduating from or leaving school.
    24     (2)  Preparation for participation in the adult community.
    25     (3)  Vocational and functional living skills as preparation
    26  for employment, continued training and independent living within
    27  the community. Functional living skills shall include self-care
    28  skills such as money management, banking, cooking, cleanliness
    29  and personal hygiene, human sexuality, communication and social
    30  skills and the use of public transportation.

     1     (4)  Information for the student and parents or guardians on
     2  services and programs for disabled adults, how to apply for such
     3  programs and contact or resource persons in such programs.
     4     (e)  The plan shall be reviewed at least every two (2) years,
     5  until the student reaches eighteen (18) years of age. Thereafter
     6  the plan shall be reviewed annually until the student graduates
     7  or reaches twenty-one (21) years of age. Parents may request, in
     8  writing, a review of the plan prior to the scheduled meeting.
     9  The request shall be to the entity implementing the student's
    10  individual education program.
    11     (f)  Parents or guardians shall be informed of meetings of
    12  the multidisciplinary team to develop the individual transition
    13  plan. The parent or guardian shall be permitted to attend all
    14  planning meetings but shall not be required to attend such
    15  meetings. The parent or guardian shall be provided with a
    16  written individual transition plan stating the services to be
    17  provided as required under subsections (b) and (d).
    18     (g)  The individual transition plan shall be developed in
    19  conjunction with the individual education program, adopted
    20  pursuant to the regulations and standards of the State Board of
    21  Education.
    22     (h)  The State Board of Education is authorized to develop
    23  regulations and standards pursuant to the provisions of this
    24  act. The Secretary of Education shall be responsible for
    25  implementing the regulations, standards and provisions of this
    26  section.
    27     Section 2.  This act shall take effect in 180 days.
