                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for inspection of garages and
     3     dealer premises by police; and requiring certain persons to
     4     keep accurate records of motor vehicle sales and
     5     dispositions.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 6308 of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 6308.  Investigation by police officers.
    11     (a)  Duty of operator or pedestrian.--The operator of any
    12  vehicle or any pedestrian reasonably believed to have violated
    13  any provision of this title shall stop upon request or signal of
    14  any police officer and shall, upon request, exhibit a
    15  registration card, driver's license and information relating to


     1  financial responsibility, or other means of identification if a
     2  pedestrian or driver of a pedalcycle, and shall write their name
     3  in the presence of the police officer if so required for the
     4  purpose of establishing identity.
     5     (b)  Authority of police officer.--Whenever a police officer
     6  is engaged in a systematic program of checking vehicles or
     7  drivers or has articulable and reasonable grounds to suspect a
     8  violation of this title, he may stop a vehicle, upon request or
     9  signal, for the purpose of checking the vehicle's registration,
    10  proof of financial responsibility, vehicle identification number
    11  or engine number or the driver's license, or to secure such
    12  other information as the officer may reasonably believe to be
    13  necessary to enforce the provisions of this title.
    14     (c)  Inspection of garages and dealer premises.--Any police
    15  officer or authorized department employee may inspect any
    16  vehicle in any [public] garage or repair shop or on the premises
    17  of any dealer, salvor, scrap metal processor, or other public
    18  place of business for the purpose of locating stolen vehicles or
    19  parts or vehicles or vehicle parts with identification numbers
    20  removed or falsified. The owner of the garage or repair shop or
    21  the dealer or other person shall permit any police officer or
    22  authorized department employee to make investigations under this
    23  subsection.
    24     (d)  Records.--Every salvor, junkyard operator, scrap metal
    25  processor, designated agent and dealer shall keep accurate
    26  records of motor vehicle sales and dispositions. The records
    27  shall include the make, year and type of vehicle, from whom
    28  purchased or acquired, and date, vehicle identification number
    29  and date of sale or disposition of vehicle. The records shall be
    30  available on the premises of the salvor, junkyard operator,

     1  scrap metal processor, designated agent and new or used car
     2  dealer and open to inspection by any police officer or
     3  authorized department employee. The records shall be maintained
     4  for three years from the date of disposition of the vehicle.
     5     (e)  Penalty.--Any person violating subsection (d) commits a
     6  misdemeanor of the third degree.
     7     Section 2.  This act shall take effect in 60 days.
