AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further defining an offense relating 3 to free tobacco samples and confections. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6306 of Title 18 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 6306. Furnishing cigarettes or [cigarette papers] other 9 products. 10 (a) Offense defined.--A person commits an offense if he 11 furnishes to any minor, by gift, sale or otherwise, any 12 cigarettes or cigarette paper. 13 (b) Grading.--Whoever commits an offense under this section 14 shall, upon being convicted thereof in a summary proceeding, be 15 sentenced for the first offense to pay a fine not exceeding $25 16 and for the second offense shall be fined not exceeding $100; 17 and for the third or subsequent offense shall be guilty of a
1 misdemeanor of the third degree. 2 (c) Free samples.--It is an offense under this section for 3 any manufacturer, distributor or vendor to provide free samples 4 of any tobacco product. 5 (d) Confections.--It is an offense under this section to 6 sell or distribute, by any means, confections, including chewing 7 gum, which mimic or resemble any tobacco products in any form. 8 Section 2.
