                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for complaints when officers fail
     5     or neglect to perform their duties.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 604 of the act of June 24, 1931
     9  (P.L.1206, No.331), known as The First Class Township Code,
    10  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    11  amended to read:
    12     Section 604.  Failure of Officer to Perform Duties.--If any
    13  township officer refuses or neglects to perform his duties, the
    14  court of quarter sessions, upon complaint in writing by [one
    15  hundred citizens, owners of real estate residing in] five per
    16  centum of the registered electors of the township, may issue a
    17  rule upon such officer to show cause why his office should not
    18  be declared vacant and another appointed in his stead. Such rule
    19  shall be made returnable not less than two weeks from its date

     1  of issue. Upon hearing and proof that the facts alleged in the
     2  complaint are true, the court may declare the office vacant and
     3  appoint another in his stead, to hold office for the unexpired
     4  term.
     5     Section 2.  This act shall take effect in 60 days.
