AN ACT
1 Providing for a nonbinding referendum relating to a mandatory
2 seat belt law.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Referendum.
6 The Secretary of the Commonwealth shall cause to be placed on
7 the ballot at the next general or municipal election a question
8 to determine the will of the electors of this Commonwealth with
9 respect to a mandatory seat belt law. This referendum shall be
10 advertised and conducted in accordance with the act of June 3,
11 1937 (P.L.1333, No.320), known as the Pennsylvania Election
12 Code.
13 Section 2. Form of question.
14 The question on the ballot shall be phrased in substantially
15 the following form:
16 Do you favor a legal requirement for the mandatory use of
1 seat belts by passengers in automobiles?
2 Section 3. Canvass of votes.
3 The county boards of elections shall, in the manner provided
4 by law, canvass the votes and make their returns to the
5 Secretary of the Commonwealth who shall certify the results to
6 the Governor and to the General Assembly. Returns shall also be
7 made available to at least six newspapers of general circulation
8 within this Commonwealth.
9 Section 4. Effective date.
10 This act shall take effect immediately.
